TLDR : Answer Summary
A Thai national is inquiring if her foreign husband's mother can apply for a Non-O dependent visa based on his Non-O visa, which is obtained through employment in Thailand. The comments suggest that the mother-in-law may not qualify for a Non-O visa as a taking parent but may need a Non-B visa based on the husband's employment. For both scenarios, specific documentation is required and it's advised to consult the Thai consulate or local immigration office for clarity.

Your mother-in-law may not be able to get a Non-O trailing parent if your husband has Non-O married to a Thai with a work permit.

If he wants to get his mother as a trailing parent, he may need to get Non-B based on employment, not Non-O being married to you.

You are asking TWO questions in this post:

1. "How would my husband acquire a Non-O Visa for his mother based on being over 50"?

2. "How would my mother-in-law acquire a one year extension of stay based on being a trailing parent to a foreigner who is allowed to stay in Thailand temporarily"?

For the first question, that would be a question to ask the Thai Consulate where your mother-in-law is residing, and if they are issuing those visas. IF they are, expect the following documents to be required:

1. Her passport with at least one year remaining and two blank pages.

2. Proof of residency of the country the applicant is residing, if the applicant is not residing in the home country.

3. Two 2” x 2” passport photographs.

4. The visa application.

5. Your husband’s birth certificate (or other documents) showing that the mother-in-law is his mother.

6. A copy of your husband’s Non-O visa Based on Marriage to a Thai National

7. 2K THB in local currency

For the second question, that would be a question to ask the local immigration office where the mother-in-law is residing. Expect the following documents to be required for this extension of stay:

1. The applicant’s passport and a copy of:

a. The data “picture” page.

b. The most recent visa (if applicable).

c. The most recent entry stamp or extension of stay (if applicable).

d. The departure card (“TM 6”) that should be stapled in the passport.

2. The extension of stay application form (“TM 7”).

3. A copy of the submitted Notification of Residence of Foreigners form ("TM 30”).

4. Your husband physically next to her, and:

-Their original passport and a copy of their data “picture” page, and their extension of stay or visa.

5. A copy of the birth certificate showing proof of relationsihp

6. 2x passport sized (4cm by 6cm) photos.

7. 1,900 THB processing fee.

thank you for your information. I read the dependant visa requirement and some said it's impossible for parent to follow child over 20 y.o. so I was wondering is it true. Because I used to ask embassy in her residing country and they said they issue if my husband has work permit but when i search for extension in Thailand. People said following child over 20 y.o. is impossible

That's for a different extension of stay. Children under 20 years old may be in Thailand to study, and the parents can get an extension of stay based on being a guardian to the child. The parent will need 500K THB in a Thai Bank Account, seasoned for three months (if my memory serves me correct). Naturally, your mother-in-law will not qualify for that visa or extension of stay.

Bangkok Immigration Office sells the extension of stay you're looking for, but I'm not sure what the other immigration office requirements would be:
