I and my wife both over 50 and plan to retire in Thailand next year.

I know that the simplest way is to apply for retirement visa both of us.

However, I want to know that is it possible for my wife to apply dependent visa with my retirement visa ?

Thanks a lot

TLDR : Answer Summary
The question addresses the possibility of applying for a dependent visa for a spouse (Non-O visa) based on the husband's retirement visa in Thailand. Responses clarify that while a dependent visa is not typically possible within Thailand under these circumstances, it might be obtained from a consulate prior to arrival. Additional requirements, such as providing a certified marriage certificate, are also highlighted as necessary for the application process.

Your best bet is to contact that Thailand Trade and Economic Office in Taipei (which takes the place of the consulate) and see if you can apply for the 90 day Non-O based on 'retirement' and your spouse can apply for the 90 day Non-O based on 'trailing spouse' BEFORE you come here.

That way you both will get stamped in for 90 days and then both you and your wife can get the year extension(s).

Mor than a few people have had to do that before comin' here if they're doing what you're planning (retirement & trailing spouse).

Ok, this seems to be the safest way. I'll try to ask for 90 days Non-O approval first.

please note that the Thai embassy in Vientiane refused to give a Non O for my wife, 2-3 weeks ago. Instead they gave a TR tourist visa which is not what we wanted.

not quite correct there
@Lee ******
😮 , Non-O visas are sold at most consulates for various reasons (being over 50, married to a thai, raising thai children, volunteering, trailing spouse, etc)

It's just inside the country few if any offices will issue a 90 day Non-O visa based on being a trailing spouse who is married to a foreigner on a 'retirement visa' 😕

AND

since covid more and more consulates in the area aren't issuing it either and definitely not until the primary spouse has their year extension inked in already

Understood. So after I got my retirement visa, I need to go outside Thailand (such as Malaysia) with my wife and then apply for 90 days Non-O visa at the local Thai consulate. Is it correct ?
Tod *********
@Lee ******
you need to FIND a consulate that will issue it first (
@Thaddée ***********
just said Vientiane won't do it 😕)

@Thaddée ***********
did you already have your year extension issued when your wife went to vientiane to apply for the trailing spouse 90 day Non-O?
Thaddée ************
@Tod ********
yes, I already had my 1 year extension based on retirement and Chiang Mai as well yourself had recommended that course of action. Should have gone to Savannakhet, maybe a different outcome. Vientiane is a no no.

@Thaddée ***********
thanx for that info, will scratch Vientiane off the list of 'trailing spouse' 90 day Non-O visas 😕 Sorry to have sent you on a wild goose chase..

At least your wife has a 60 day tourist visa so some time to figure out what course of action to take

@Lee ******
there is a lot of contradictory info about these Non O for trailing spouses. We did what Chiang Mai immigration had suggested. Upon return to Chiang Mai, immigration suggested we try to get the trailing spouse Non O in another country such as Cambodia or Malaysia

@Lee ******
one other thing for this trailing spouse visa/extension is the certification of the marriage certificate by your embassy (if it's offered in thailand) and/or by sending it back to your country (as people who were married in the UK have to nowadays)

Many immigration offices require the foreign marriage certificate to be certified SO check with your immigration office when you are going thru the Non-O process for the primary retirement visa holder and let them know you will have a 'trailing spouse' and see what they tell you as far as what you need to do with the marriage certificate.

We are from Taiwan. I will get marriage certificate in English from government and then certified by public notary before going to Thailand. Is this can fulfill the requirement?

@Lee ******
check with the Thailand Trade and Economic Office in Taipei to see what you should do (if anything)

Yes, I know this office. Thank you

So you will meet the financial requirements (800K baht in a thai bank account in your name only) and get first the 90 day Non-O visa and then 2 months later get the year extension?

Unfortunately your wife cannot get a Non-O visa based on being a trailing spouse to someone on an Non-O (retirement) inside the country at most immigration offices.

(There are reports that the Phuket office recently changed their policy and will allow 'trailing spouse' Non-O's to be issued in country with a spouse on retirement but no reports that anyone has actually done it yet.

Most other offices ill not issue it at all, meaning you get your 90 day non-O, then the year extension and send your wife to a thai consulate nearby to get the 90 day trailing spouse Non-O after that.

sorry, it should be 800k and 1600k respectively

Thank you very much

@Lee ******
the trailing spouse doesn't have financial requirements only the primary retirement visa/extension holder; 800K baht in a thai bank account in their name only, or 65K baht a month transferred into the country from abroad each month, every month for the previous 12 months before you apply for an extension OR an affidavit of income from abroad notary letter from your embassy stating you get a minimum of 65K baht a month income.

By using the above process, Is it right that only the primary needs to have bank deposit 80kbaht ? ie. only 80k for both instead of 160k for 2 retirement visa

HI Tod, according to your info, then how can a spouse below 50 can long stay in Thai? Only the 90 days non-O?
Tod *********
@Lee ******
tourist visa, take the 30 day extension that gives 90 days, and that should be long enough for the primary to get the Non-O and then the year extension, if not they'd have to bounce out and back again to buy more time.

@Tod ********
Yes, I know the primary can get one year retirement visa. But how about the spouse? Do she apply for dependent visa together with my application or after I get the retirement visa?
Tod *********
@Lee ******
as I said it is up to the immigration office, MOST will not let her apply for an in country Non-O visa based on a marriage to a foreigner on a retirement extension.

SO she comes in on a tourist visa, waits while you go thru the process of getting the Non-O and then the year extension and then takes the documentation with her to a thai consulate to get a 90 day Non-O visa based on trailing spouse and after that gets an extension at the immigration office that matches yours.

HI Tod, thanks for the clear explanation and I understood now. My wife actually also over 50, is the above process still work? Because I have heard that people over 50 must apply for retirement visa individually.

Thanks

@Lee ******
There is no rule about age and getting trailing spouse Non-O visa/extensions. makes no difference if she's over 50 or not.
