Can I get a new Non-B visa at the Thai embassy in Penang after canceling my work permit by doing a land crossing into Malaysia?

Hi, I have a Non-b visa which I’ve had for 12 months this coming January. My work permit will be getting cancelled before my visa expires (I’m aware of what I need to do).

My question - can I do a land crossing into Malaysia and head to Penang Thai embassy for a new nonb?some say you have to fly out? I will have all the correct documents. Thanks

From my experience, no. You cannot get a new non-B visa until the other one has been 'closed'. This means you have paid and evidenced all required tax and SS payments and that your current employers have sent a letter stating you fulfilled your contract. There are a few documents (see attachment below), and all of these must be originals (unlike in the immigration advice attached, where it says copy, it means original) and can ONLY be supplied by your last employer. You cannot even transition to a retirement visa without 'closing' the work visa first. So, I really hope you left on good terms because there is no longer a legal requirement for your previous employer to supply these items. sounds like exactly the way the system is designed to work, cancel the work permit, cancel the extension, exit, go to consulate and get a new Non-B (y)

I’m aware of the cancel work permit at labor office, head to immigration to cancel visa, extend stay for 1900, leave the country.

there is no option to extend your stay, if you're on an extension of stay you need to cancel your extension on the day you stop work and leave the country. You can cancel in advance with a letter from your employer stating the date you stop working.

Yes there is, he can get the "7 day get-out-of-dodge" refused extension extension.

although that is not an extension and you can't apply for it as such so if they don't accept your application for an extension (which you're not entitled to) they won't issue the 7 days get out of the country stamp. Much better to cancel in advance with a letter from his employer

how can you do it in advance if you have to cancel WP and visa the same day? I have actually heard of quite a few people receiving the 7 days “grace” to leave. Going to labor office, followed by immigration, followed by the airport in a single day? I don’t think so!!

, there is no "grace" period of 7 days unless you are currently working for BOI/IEAT company. you go to the labor office to cancel your WP, and bring the WP cancellation receipt to the immigration office to cancel your extension. Many people do it in one day. Also, you can apply these cancellations several days in advance. How long in advance depends on your local offices, though.

You can try to apply for another extension which will be denied so they MIGHT give you up to a 7-day-to-leave stamp. You want to apply for this extension on the very last day because 7 days to leave the kingdom would start on the day of application, not to be added if it's granted.

the visa expires on Jan10. The work permit is valid until mid next year. So have the letter from the employer stating the last day of work which matches the expiry of the visa. That sounds like the easiest way

Yes, take that to Immigration and you'll get your extension stamp cancelled and a new one with an exit date of 10-Jan, do this at least a week in advance, not your last day.
