Will my landlord's failure to file a TM30 affect my 90-day report in Thailand?

My landlord is very uncooperative. If she doesn't file a TM30 upon my re-entry to Thailand, will this be an issue when doing the 90 day report?

Everytime you enter Thailand it's a fresh new entry in terms of tm30 and the agent/landlord need to lodge a new tm30 by law. If they fail to do it then they can be fined, however, some might argue that for individual landlords/agents this one is bit relaxed or not properly enforced. Although you can always remind that it the law for landlord or agents to lodge tm30 within 24 hours when a foreigner starts residing in their house, otherwise there might be huge fines. It's also clearly written on Royal Thai Police - immigration bureau's website. You can take a screen shot ans share with them. Hope this will convince them to lodge the tm30.

Did your landlord provide you a copy of their ID card and blue house book when you signed the contract? If you have these 2 things then you can register on the TM30 website and file the TM30 yourself.

You should be asking for copies of these anyway when signing a rental contract to prove that the person renting the property is the legal owner and that they are who they say they are.

I setup the web site for my fiance and file my own TM30 using her login when im in country bc she “doesn’t have time to mess with that government crap” 🤣

That would be your landlady. Offer to do it for her. All you need from her is the house book (take a photo of the page with the address - first page and the page with her name as the owner). Now you can register the property with Imm and then do your own TM30s. Forget about the spreadsheet thing that is for hotels. Just do the individual notification. I do this.. it’s easy.

Ususally they avoir reporting to avoid taxes but if you start telling them you will goto report this to police they suddenly get more cooperative…..

Yes. You also need it for residence certificate. I tend to ask this before I sign a contract. Many won't do it even they legally have to.

I was told by the Samut Prakan immigration office that a new TM30 needs to be filed every time you re-enter Thailand if you are not on the same visa as when you left (even if you still reside at the same address). So for example, if you rent a condo for 1 year but you are doing visa-exemption runs, then each time you return you will need a new TM30 completed by owner that shows starting date on/after latest visa-exemption stamp. However, if you re-enter on the same visa, like you would if you have DTV, then you can use your old TM30 as long as the duration of stay is still valid.

It depends on the office yiu are doing the 90 day. For example Jomtien did not need an updated TM30 after travel as long as returning to same address. No issue doing the 90 day. Chiang Mai an updated TM30 is required even if returning ti same address.

Anonymous participant 174 if your husband is not staying longer than 90 days, or doesn’t require an extension, don’t worry about it. There will be no problem if you don’t need to use immigration services such as 90 day reporting or extension.

that is why i allways make sure before renting that the landlord is ready to follow immigration laws… especially when i consider extending a visa, which would need much more documentation

I renewed my TM30 myself at the Immigration Office. All you need is your old TM30 and your passport.

A landlord that fails to fulfill their basic obligations should not be getting more money.

I was in a similar situation when the landlord's agent didn't want to make TM30 for me after my reeentering 😅 It took me a veeeery long time to make them to do it, I almost missed my queue in Immigration, and I kind of wish they would just have announced the price for the service from the beginning 😁

Unpopular advise: offer him/her money, and he/she will willingly do it. Should you originally have to pay for it? Of course not, but the only person that would face problems is you (please don't say that the landlord will be fined, we all know that it doesn't work that way).

Anonymous participant you would be told you have to get it. If you don't and do not do the 90 day report then at any point on the future you have dealings with immigration in country you would likely be fined 2000b. No worries at the airport as they don't check.
