What should we do if the Non-Immigration O visa's 'under consideration' stamp expires while we are out of Thailand?

What are our options?

My partner has been granted the Non-Immigration O visa (as my dependent here working). He went to immigration on Dec 13 and got the 'under consideration' stamp in his passport - which says to return Jan 3. Foolishly we were told by my work that the 'under consideration' would be for 30 days, so we booked a trip out of Thailand from Dec 30 - Jan 6. So he can't go back to immigration on the 3rd.

Questions:

* is there any chance he can call or go back this week to get the final stamp early?

* if he can't get the stamp before we go, can he return on a visa exempt and then start the process for Non-Immigration O visa again? Will there be any flags/issues given that we screwed up the first one?

* Any other advice/thoughts?

okay we finally got to the bottom of this

The O/P's partner is NOT applying for the initial 90 day Non-O trailing spouse VISA. They have that already. ๐Ÿ˜ฎ As she clearly stated in the opening sentence ๐Ÿ™‚

What they did apply for was the matching year extension based on being married to a foreigner who legally works here. ๐Ÿ™‚ When they did that they got a 3 week under consideration stamp INKED into their passport.

This is actually part of the year extension the person will get when they go back on the date the under consideration stamp runs out to get the extension that matches their spouse's inked in.

Because they're not going to be IN the country when this current under consideration stamp expires, IF they don't want to lose this whole thing and start all over from ZERO they need to go to the immigration office.

When they're there they show proof they will not be in the country when the stamp runs out, get the officer to extend the under consideration stamp and THEN buy a re-entry permit to keep this stamp 'alive' so they can get stamped back in on it when they return to thailand after their holiday.

All you can do is GO to your immigration office with your passport and his and see if they'll ink in the stamp early. Worst they can say is no and you lose everything and you start all over from scratch applying for the Non-O visa and then the matching extension.

There is no one on here that can tell you IF it's gonna cause any issues because the first one came off the rails, ASK the immigration office when you go there this week to see if they can do that stamp early

or if u have a valid stam gramnting you stay longer than your trip u can check if reentry permit is enough and meet again on jan 7

A re-entry permit issued under these conditions will only be valid up to the date on the Under Consideration stamp so it would be of no use

unless they can get the immigration office to move that under consideration date out (which immigrations CAN do with just cause) ๐Ÿ™‚

face it worst they can say is no, can't get the stamp early and then you know you're back to square one when you come back from your holiday. It's not the first time it's happened I'm sure of that ๐Ÿ™‚
