Why was my father stopped at the airport after obtaining a tourist visa for Thailand?

Hi everyone,

I just desperately need help about these things. My dad is from Scotland and he has overstayed his visa, not sure for how long, but before he went back to his country we asked the immigration how long he was to stay before he can re enter Thailand and they said 1 year. And now after 1 year he has done his visa (60 days) and as he was about the get on his flight back to Thailand he was stopped by the airport, is there a reason for this? Could this just be the airports error or is he still on the blacklist? I've tried asking thai people one threads but most seem to not want to help, so i'd rather talk to someone who really know. I'm not really good with these things so please bear with me.

Thanks in advance and hope you guys can help with my situation.

I suggest the O/P get his father to email the paperwork he's got and a copy of the data page of his passport.

Then take it to the Suan Plu Immigration Office.

If the blacklisting is truly expired they can remove him from the database

I am no expert however last year In overstayed my visa by 14 days and they told me that if it had been 30 days I would be banned for 5 years.

The only way you'd have been banned for 5 years is if you were caught out on an overstay of less than one year and prosecuted for it.

Showing up to clear an overstay of under 90 days at the airport (which constitutes turning yourself in) doesn't have any banning penalty just the overstay fine.

Why did he get a tourist visa? Why didn't he get the appropriate O-A retirement visa, which allows you an easier process to the retirement visa extension.

If he was stopped. Did he show the Authorities his Visa?

Did they supply an explanation?

The case is clear to me. The Airline need to submit a passenger list to Thai Immigration and he is still on the blacklist, hence he got refused during boarding. AFAIK the Blacklist is maintained manuelly by Thai Immigration. Before the implementation of the blacklisting by 1,3,5 or 10 years everyone was marked for life. I suggest the OP goes with a trusted Thai person to Thai Immigration at Suan Plu and ask politely about his father status. No need for Lawyer.

You're not clear in your comment: there are 2 spots where your father can be denied to proceed: A. The airline desk or B Customs. If it was because of no return ticket, he would know it because airline staff would tell him. Besides, it's extremely rare that airlines make a fuss about this. It's not a visa issue since A, he doesn't need one as he can get into Thailand on the 30 day exemption and B, he has a SETV. In my opinion, it has to do with his past overstay or something happened at the airport, like him maybe having a few drinks before the flight. Note that he could also be blacklisted by that particular airline for an on-flight incident in the past. If customs stopped him, it would have to do with a serious legal concern in the UK in regards to your dad, like being on probation.

Stefan, you will almost certainly be refused boarding a one way flight to Thailand from UK without a visa and proof of onward travel or perminant residency. Although rarely asked for when entering Thailand on a 30 day visa exemption, proof of onward travel within 30 days is a requirement to obtain the exemption. The is why most airlines wont let you board with only a one way ticket.

He has a Tourist Visa in his passport, so that is not the problem. And you do not need a RETURN ticket if you fly without visa, but proof of onward travel.

If you don't have a visa already in your passport they won't let you fly without a return.

The airline saw that I didn't have a return ticket and initially refused me boarding. That was until I pointed out that I already had a visa in my passport secured from the Thai consulate in London.

the reference in TIMATIC warning of the need for a return ticket does *specifically* refer to "visa exempt". What an individual airline does is their own business but I have pointed out the visa before and asked them to look it up in TIMATIC. It's down to the airline at the end of the day.

Gettng a SETV from the Thai Embassy in the UK is easy send your fee a SAE passport 2 photos and a completed form. You dont need to show funds or even a ticket

He wants to make a Visa here, does this means in Thailand or in Scotland. What kind of Visa he has to go to Thailand or want to come without visa? There is no Thai Immigration on airports in Scotland who stop him from boarding. If he has a single way ticket, no visa, overstay stamps in the passport, black list stamp in the passport, I applaud the airline company, because they are responsible for him when his entry into Thailand get refused.

As said earlier, the airport in Scotland has no access to Immigration database. Show them the papers of black list till 6th may and the new visa of Thai Embassy.

The airline said he was restricted by the Thai Immigration. The airport tried to help out by calling Thailand but it was the weekend no one answered and nothing was done. Dad and the travel agent have communicated with the airline this week and they have confirmed he is still on banned list.

How is this possible? Did they perhaps forgot to remove him from the list or are the just slow?

Airline company and Consulate/Embassy do not have acces to black list database from Immigration of Thailand, so they do not know. Unless the stamp in passport.

If he is blacklisted there is a stamp in his passport and he must have some paperworks from it. They not only tell you.

He has a tourist visa(60 days) and when he gets to Thailand he wants to renew it to a retirement visa. I also forgot to mentioned that he was arrested for drunk driving once. And he was told to not cause any trouble for one year

David Weiskopf. That's not correct. On flights from the UK to Thailand and many long-haul flights you need a return ticket or proof of onward travel. BA, Quantas and Emirates wont let you fly with a 1 way ticket to Thailand on just a TV

Could be as Noel is suggesting no return ticket could be they haven't cleared him from the system. The airline would of told him. Actually come to think of it in Scotland dont they check at the airport you have paid any court fines TV licenses and similar before you are allowed to leave.

If your dad was caught can be 5 to 10 years if he surrendered to authorities say at immigration and was more than a year will be 3 year.

He went to the immigration, i think he overstayed for less than a year, i think it was around 2-4 months

whatever works... it is likely the cause of his being turned away at the airport ; I know several people in the States who has the same problem- I was flying once from Taiwan and the airline wouldnt sell me a one way ticket- I had to go to the Thai consulate and explain to them that I was headed for Cambodia by land and they wrote a special note to the airline for me.

have him buy any cheap air asia ticket out of Thailand for sometime before the visa expires- he can throw it away or use it - probably no return ticket is the reason
