I have just been asked

A guy john had overstayed his visa by over 3 months and is now home in France, he asked me the procedure to get a non 0 90 day visa, i told him to check first if he could get back here, as i think if someone overstays by so long it is a year ban on coming back,

He then asked about a non 0 based on marriage, he is not married as yet they are planning.

Im guessing that would not make a difference, i asked if he could get any visa, he said he couldnt get one before, petsonally i think its a bit fishy.

anyway am i right to tell him he needs to wait till a year is finished?

TLDR : Answer Summary
A person who has overstayed their visa in Thailand by over three months, like John, is likely facing a one-year ban from re-entry. Even if he applies for a NON-O visa based on marriage, it may not be applicable as he is not yet married. It's advisable for him to consult the Thai embassy to confirm his visa status and clarify whether he is blacklisted.

When exactly did John leave after his overstay?

So I guess the current overstay rules apply then.

Many times if people don't have a black listing stamp in their passport the Thai Embassy or consulate will sell them a Visa without a problem because consulates aren't on a database. The problem is when they enter the country there denied entry.

I guess it will take you a friend coming back here to find out if he's blacklisted or not for overstay

I'm not inspector Clouseau but as he couldn't get a visa before, that might be the clue were all looking for ๐Ÿ˜‚

The Embassy may still give him a visa, as they may not have all the details of blacklisted people...but for sure on his arrival the Immigration Officer will know, and he will likely be refused entry. Even though someone may be given a visa, the final decision on entry is made by the Immigration Officer on arrival. A visa does not guarantee entry.

Well for sure he has a big problem to get a visa now! Normally he is blacklisted for a year . So first urgent he need to ask the Thai embassy first !
