What are the visa requirements for a newborn returning to Thailand from France?

Hello, anybody can inform me about this case or have been in similar situation?

My gf is pregnant (not Thai) and we plan to give birth in France, we both have a working permitt and Non B visa.

In that case what will be required for the child when we return to Thailand? Shall we make a visa for the child

If the baby or child doesn't have a visa, they will be stamped in visa exempt when they arrive at BKK. If they then overstay there is no fine or ban, but when they leave Thailand their passport will be stamped 'overstay'. This shouldn't be an issue, but if the parents plan to live in Thailand and if the child may eventually go to school in Thailand, I would get them an O visa as your dependent and then they can be added to your Extension of Stay.

At the very least you will need the birth certificate to prove it isn't trafficking in order to return to Thailand. Check with the Thai embassy on what other documents the mother will need, as you are not married. Also your doctor in France should coordinate with your doctor in Thailand, if you intend to bring the newborn back in the first few months, so needed newborn vaccinations can be coordinated, and health records transferred. Try not to be against these, as there are endemics in Thailand, and not talking about covid, that can kill if not vaccinated against.

Although it’s not necessary as a child can’t be fined for overstay it probably is a wiser choice to have the correct visa from the start. Once you have their passport apply for a non O dependent visa. There is no financial requirements for that visa. Depending when you’re coming back you may have to apply for a certificate of entry for the baby too.

I tried to Google that but didn’t get anywhere. The OP was asking about living here long term (they’re on work permits) so technically the child needs a visa to stay. I’m not talking about tourists travelling with a child for holidays.

with the greatest respect you are in a different position to the OP. In their case the baby has, or will be, born in France to non Thai parents. The baby won’t be eligible to a Thai passport like your son. Without a Thai passport then getting a visa and extending it at the same time as one or both of the parents is the best solution.

Initially the baby would be given a 90 day visa. Once you’re back here you apply for an extension of stay based on one of your long term visa. Again no financial requirement other than the 1,900 application fee.

If they're old enough to get a passport they should have a visa. Pretty sure under 2 years of age don't require a passport or visa for entry. Not 100% of that though.

That is TOTALLY NOT CORRECT INFO 😮

Let's read the actual rule. It states that children under 15 cannot be fined for overstay and it states children under 18 cannot be banned for overstay

NO WHERE in the rule does it say that children don't need visas to stay here (they do believe me) all it states is that there's no penalty for overstay.

Also once your child goes on overstay you can't get an in country visa issued (because they cannot be issued to people on overstay) SO my advice to

sorry but you and Peter are mistaken. The fact that you can’t be fined does not mean you don’t require a visa. Who knows how the laws may change in the future and by not having the correct visa what that may entail. There’s basically no cost to getting one so why not be legal to start with.
