Is there any flexibility on the 40,000 Baht monthly income requirement for a marriage visa in Thailand?

Just a quick question Reguarding 40k baht per month marriage visa. If the baht increases against Aus dollar and my income drops to say 39,900 month is there flexibility when applying ?

Mogens Nygaard. Haven't heard that. I know CW just wants to see confirmation that a monthly amount (in my case it's 65k) has been transfered from overseas. They're not even interested if it came from my bank account. The bank provides a letter listing the international transfers for the preceding 12 months which CW accepts. I only assume the same for the marriage visa

, yes, as long as you have all the documentation required, as it is quite a bit more than for a retirement extension. The money has been directly deposited into your personal Thai bank account from overseas, and not received by some other means, like ATM withdrawals, then deposited by you right? If it came directly into your account from overseas then it will work just fine. Also, for a retirement extension that I assume you are on now, you should be either receiving bt65,000+ a month, or have bt400,000 in your bank account right now, as the financial rules now require that bt400k stays in your bank account all year, and the full 800k is there 3 months before renewal, and two months after, I think, but it might be longer, but the bt400k must be in there all year. If you by chance have the bt400k in your bank account, just start the process to change your extension to married now, instead of waiting, as bt400k in the bank for two months is one of the options to meet the financial requirement, or the bt40k every month. Under a marriage extension you can also get a work permit, if you decide to work, and meet the requirements, something you can not legally do with a retirement extension.

That will work, just wait two months after you deposit the bt400k, and it doesn't matter where that came from, but, go to immigration right away, as they have a list of all the documents you need, and take your wife with, as there are more things that you need that are not on the list, and, immigration likes to always see you with your wife.

While it does say "an average of 40K baht" on the police order for marriage extensions ALL the immigration offices I know require a minimum of 40K per month meaning there is ZERO flexibility in meeting the proof of funds using monthly income. :O

If your embassy doesn't issue the affidavit of income from abroad notary letters anymore (US, UK, Australia, etc) your only option is to transfer a minimum of 40K baht a month each month every month into a thai bank account in your name only for the preceding 12 months before you apply for your extension.

Can you get the pension payment made early in the month, then if the amount drops below 40,000, say for example 39,900, you then have plenty of time to make an additional payment of 100 baht (or more of course) to ensure you still have the 40,000 covered?

, you are NOT correct. There is no "combination method" when applying for an extension based on marriage to a thai, it's either ALL banked money (400K) or ALL monthly income. You are confusing a marriage extension with a retirement extension that does allow a combination method (part banked money and part monthly income)

My fear is that the minimums for the marriage visa will be boosted to that of the retirement visa (65k baht per month or 800k in a Thai bank, plus health insurance). I would still be in the clear, but not by much. My funds are transferred monthly from the U.S.

, in the past they have always grandfathered in the rate, as long as you are still getting the same extension. I know a few people that stayed here married from the Vietnam War, and they are still only required to meet the bt20,000 they were required to have in the bank originally, as long as they never change, or loose their marriage extension, until they die. Now, in the last 19 years I am aware of the actual rate hasn't changed, only how it has to be met. It used to be that condo ownership value could be used to meet part, or all of the financial requirement, but no more.

..I think.your not far from the truth. Only problem is 40,000 a month is more than enough for me..own a car/motorbike, own a house, have A1 insurance and no other financial comments. Even have additional income from rubber tree plantation in Thailand., which is not taken into consideration.

I know they have to draw the line somewhere but the way the baht fluctuates it's only going to get harder to substantiate

I have heard some immigration offices are flexible...but what they would do is ensure you have an average of 40,000 each month.

So if one month you have 39,900, the next you would need at least 40,100. I think it's easy enough to avoid getting caught out - depending on the transfer service you use, you'll know exactly how many Baht you're getting because the rate is locked in when you make the transfer, even if it arrives 3 days later.

Unfortunately no. It used to be that you could average it out over the course of the year, but not anymore. It must be bt40k+ a month, no exceptions. You also used to be able to combine money in the bank with money deposited each month so it totalled to bt400k+ for the year, but no longer either. It must be bt40k+ a month.
