Does My Friend Need to Submit a 90-Day Report After Ceasing Employment in Thailand?

Hey, asking on behalf of a friend so I’m including as much information as I can. Don’t know if it’s all relevant.

Person has entered the Kingdom on a Non B Visa sticker on the 24th of Jan and on the 4th of February an extension of stay based on employment was granted until dec 2021.

There is a TM47 stapled that says next reporting date is the 29th of July.

Since then, the person has ceased working the company that employed him & they’ve cancelled their WP & Extension of Stay as of the 31st of July.

The company is now requesting the person to complete a 90 day report and has sent the person a completed TM47 to take for submission that they are saying was due on the 31st of July.

The persons passport (british) has not been updated by immigration as yet with the 7 day leaving stamp since the cancelation of the WP. This is being done on Thursday with the company.

Am I right in assuming that the person doesn’t need to submit a 90 day report as 90 day reports were suspended due to Amnesty? Or are they still required to report?

Many thanks for your help 🙂

Aaron

TLDR : Answer Summary
A person holding a Non-B Visa, who has had their work permit and extension of stay canceled after ceasing employment, is uncertain about their obligation to submit a 90-day report, particularly in light of the recent amnesty for reporting requirements.

On the day your friend stopped working , he had to visit the Ministry of Labor to cancel his work permit and after that the Immigration Office to cancel his Extension of Stay. It looks like nothing is done yet, so best way to take action is visit those offices and cancel both.

great, appreciate the help.

The company let employees go few months back, but kept WP active. They approached the person last week wanting to cancel on the 31st.

I’m trying to hire said person, however there’s delays on paperwork for my company here and we were trying to get them to hold off from canceling so we could transfer the WP across.

the 90 day report is the least of his problems, first cancel and when he is there, he can just ask the officer
