Do I need to transfer my non-B visa stamp to my new passport before canceling it?

Hello. I have visa, passport and 90-day-report questions related to my new passport.

I have a non-B visa through my employer. My contract ends on March 31st and I am flying back to the USA to visit my parents on April 4th. The employer has agreed to cancel the non-B and work permit on that date. I will return on a tourist visa later in April.

The wrinkle is that I got a new passport recently (pages were almost full in the previous one). I received a letter with the passport asking Immigration to transfer the non-B stamp to the new passport. Will I even need to do this? Or is it an administrative requirement to transfer the stamp and then cancel it?

The employer is giving me an official cancellation letter today, but we are wondering whether or not that is necessary either. In any case I just don't want there to be any problems when I return.

The second question is about the 90-day report. My employer used to do this for me, but since I got a new passport she says that I have to make a special trip to Immigration to file there instead of doing it online.

So again, the question is: Do I even need to do this since I'm leaving on April 4th? I had traveled to Vietnam and returned on January 1, 2019, so there would indeed be 4 days extra days 'unreported'.

Your advice would be appreciated. Thank you.

While you're out there (AFTER you get your stamps transferred and cancel your current extension) file your 90 day report too (seeing as you can do it 15 days early and up to 7 days late) . ;)

Then you're good to leave the country without anything hanging over you IF/when you ever return and want to work here again.

1 - Take the old passport and the new passport with the letter from your consulate to the immigration office an have the stamps transferred.

2- Have your employer give you the cancellation of work permit receipt and take it along with your termination papers to the immigration office a week or so BEFORE you're last date on the paperwork.

The immigration office is going to cancel your extension and then give you a new stamp until the date on the termination paper.

THEN you just stamp out on the new passport.
