Can my infant son stay in Thailand if we get year-long education visas?

If I and my partner get year-long Education visas, how does our (British) 6-month son stay? Is a dependent visa possible? I get conflicting info. If not something else? Thanks

Thanks very much everyone, sounds like Ed visas for us are possible. without causing an issue for our son, and we have options for getting our son permission if we want to be really squeaky clean.

Would an overstay not potentially be perceived by immigration guards to be against the 'spirit' of the law? I'd like to stay well within the spirit as well as letter of the law.

Could he register for school if we exit and re-enter, him with a historic overstay stamp but not currently overstayed?

just so u know i have personally seen that they do not place stamps in child's passports as they cant overstay *again this was a few years back* thanks for u comment though - but it seems like u dont know much about this loophole as i have known not only family but lots of friends who have gone through this. As long as the kid leaves before their 12th birthday they are cool. But again i advised the man to double check the laws. :) have a great day 555 cant break the law if there is none in regards to a child....but again the laws need to be rechecked been here 35 years and watched this for years :)

actually they would get a stamp. Any foreigner needs a visa or extension to allow them to stay in Thailand. If they don’t have one they have broken the law. The fact that Thailand doesn’t fine or blacklist children for doing so doesn’t mean they haven’t broken the law. They have but there is no repercussions from doing so other than a stamp on their passport saying so.

For future entries having such a stamp is irrelevant.

oh yeah - ive been here about 35 years. Best reminder - ask ask ask around.....basically you can get anything done in Thailand just never stop asking...eventually someone can pull the strings. Befriend some Hi-so ppl to, they have lots of connections lol...

I'd imagine current but as mine weren't overstaying and had a dependent visa I couldn't say for certain.

in order to get an education visa in country for a child they’d need to be on a valid entry stamp, not overstay. However it would be easy to do a border bounce, (which would clear the overstay) and re-enter visa exempt, with which they could then apply for the in country Ed visa.

the international schools I visited when looking for somewhere for my kids all wanted to see what visa my kids were on. They were my dependents so no issues but if on visa exempt/overstay then it might be a problem.

yes totally possible and of course the proper way to go....but u know things happen and ppl prefer to use the loopholes. Thailand is full of loopholes which is why many live there. Im a loophole type of gal lol. U know how many speeding tickets i never got in thailand cause of loopholes lol

he wouldnt get an overstay stamp cause there is no overstay (but double check the laws - this was how it was for many years. My sister had her kids here for 11 yrs this way - so did many others) cant break a law that isnt one

if there is no overstay for children then there is no overstay it isnt breaking a law if there isnt one lol

I forget the ages for children, but a 6 month old is well below the threshold.

Children cannot be fined for overstay or banned for overstay.

Generally you can just enter and then let your son go on overstay while you and your partner continue on your visas.

When you leave, your son's passport will get an overstay stamp, but that's it.

The issue some people with older children have is that they cannot register the kids for school while they are on overstay, but I don't think that's a factor for you.

Your son can get a dependent visa off the back of one of your long term visas. He could also enter visa exempt and just stay. There is no fine or penalty for children under 15 overstaying. They’ll get a overstay stamp in their passport but that’s it.

Anyone under 12, there is no overstay or banishment (or at least that was the rules before) ive known people who have had no visa for their kids from 0 to 11

But u can get a family visa for him because he is ur family up to u how u go about it. Thats why its the land of smiles - so many ways to accomplish something
