Can my friend with a Non B visa stay in Thailand until his visa's expiry date on February 15th?

Hello,

Asking for an Australian friend. His work permit will be cancelled in a couple of days. He is on the initial three-month Non B visa that is valid until 15 Feb and was granted in Nov 2023.

He is organising things to move overseas, and will be leaving before 15Feb.

He needs this next three weeks to get everything sorted and leave.

Can he stay in Thailand until 15 Feb?

Dear members, this is the reason this group usually don't allow posts like "asking for a friend", especially if it's about non-immigrant visa/extension.

Luckily she could get the stamps from the friend's passport. She would never be able to get the right advice without those photos, and her friend could end up overstaying.

If you want to ask "for a friend", make sure you post with related photos from your friends or let them ask on their own.

Okay, so your friend has to leave on or before the last day on the entry stamp, in this case, 14 February.

As already mentioned, the expiry date on the visa itself is irrelevant.

An entry stamp cannot be cancelled, and you can stay as the stamps show, whatever the employer says.

Tell him to get ready to leave within 14 February.

Okay, IF he used a Non Immigrant B visa and got a stamp with Admitted until 15 Feb 2024, he can stay until that date.

He has to make sure that his Work Permit get cancelled, ask a copy of the letter, do not trust employers to do this for you.

IF, please check the passport, he has a stamp with text "Extension of Stay permitted up to 15 Feb 2024" than he needs to visit Immmigration office with the letter from the Minsitry of Labor and employer to cancel this Extension of Stay at the last day of working.

Feb 15 is the expiry date of the visa. That’s irrelevant now as it was used/finished upon entry. What’s important is the red stamp in his passport that shows when they’re allowed to stay until.

The expiry of the visa is irrelevant. That was used the moment he was stamped in to Thailand. What matters is the entry stamp and when that is dated. He’s allowed to stay until that date.

it’s not possible to cancel a visa (or entry stamp off of one). They would have been stamped in for 90 days and can stay for that time regardless that a work permit has been cancelled or not.

No. it would be a different case if he was on an “extension of stay” rather than the initial 90 day stamp, as that would end the moment his job did. But the initial 90 days entry can’t be cancelled.

his workplace messaged him saying ‘ go to immigration to change type of your visa as soon as possible or go to closest country to get four weeks stay in Thailand’.

So this is not correct,right?

He can stay with his current initial non B 90-day till stamp says ie 15Feb?

- his your-call-"Non-B" was granted inside Thailand

- his "permitted to stay" date is actually 15 Feb, not the date on the visa

- that was his very first visa and he has never applied for an extension

I am going to say...

Pardon me as your question was pending for 3 hours in Post.... I will attempt to reply.

As your friend is on the INITIAL 90 DAYS of the Non B Visa and it HAS NOT been extended...IT WILL EXPIRE on departure or not later than February 15th.

Then your friend can stay no longer than February 15th.

Make sure his work permit has been cancelled. It's his responsibility to cancel it.

Please check back with us tomorrow as it's Wednesday 10pm nightime in Thailand and added Moderators are available during the day.

But I believe that I am correct.

Workplace will cancel his work permit tomorrow ie Friday.

So can others (Moderators) check if info is correct ie he can stay till 15 Feb pls? And no action/application etc needed?

It is Thurs morning so it is important to know before WP is cancelled tomorrow.
