When you cancel a work permit do you get a grace period of 7 days or similar to the 90 day or are you overstaying as soon as its cancelled?

TLDR : Answer Summary
When cancelling a work permit in Thailand, the grace period varies depending on your visa status. If you're on the original 90-day entry of a non-B visa, you can remain in Thailand until the 90-day period expires. However, if you're on an extension of stay based on employment, you must cancel this extension immediately after cancelling the work permit to avoid overstaying. Failure to do so can lead to fines or penalties for overstaying, even if you're still within the validity of your original visa.

I can only write what happened to me. My school cancelled my work permit and told me 5 days later. When I went to immigration I had to pay 5 days fine regardless of my 90 days stamp (still had 26 days to go).

you were not on a 90 day non-B visa. You were on an extension of stay based on employment.

A 90 day report is NOT an extension of stay and is not related.

IF you are on the original 90 day entry of a non-B visa when you cancel the work permit you can stay until that 90 day stamp runs out.

BUT

If you are on an "extension of stay" based on employment you need to GO and cancel the extension as soon as you cancel the work permit,. There is no grace period, you cancel your extension of stay and you BUY a 7 day 'get out of thailand' stamp for 1900baht

if you read the โ€œ90 day extension โ€œ, it says โ€œthis is not an extension of stayโ€. Your extension of stay is valid until April 30, 2022.

On your last day of employment, cancel your work permit, and then cancel your extension of stay based on employment. You have until 11:59pm the same day to leave Thailand before going on overstay .

You may be able to get the extension of stay cancelled in advanced.

Thank you. Is there anyway around avoiding this overstay? I'm going to be coming back into Thailand on a tourist visa to then get a new work permit at my new school. I don't want a red overstay stamp in my passport whilst trying to apply for a tourist visa.

, so as evidenced by your "extension of stay" stamp (dated from 24 Jun 2021 to 30 Apr 2022 ๐Ÿ˜• ) you're NOT on the orignal 90 day Non-B visa ๐Ÿ™ <- meaning you cancel the work permit and immediately cancel your extension. That means you would BUY a 7 day get out of thailand "extension denied" stamp and leave in a week ๐Ÿ˜ฎ

Thanks Tod. I really don't understand the visa stuff so thanks for breaking it down like that.

Do you happen to know the counter at which I can get this visa?

Not sure if I should reply here or make another thread. But if I originally was on a non Imm O based on marriage/family, then got a WP on that, and then later down the road for whatever reason would quit or lose the job, would I still be able to stay on the extension of stay (as long as I can show proof of 40k/month minimum from abroad, or money in the bank etc.) and just have to cancel the work permit?

Would be a worst case scenario, but good to be well prepared for all I've come to learn the hard way...

then when your work permit is cancelled you can stay until that 90 day stamp runs out.

The initial 90 days can't be cancelled even if you stop working, you are allowed to stay until it runs out.

The ONLY people I know who get a date later than their work permit cancellation date when they cancel their extensions are people who use the One Stop Service Center at Cham Churi Square (those are people on BOI or IEAT or other business visa extensions).

People who hold extensions from there can get a stamp good for up to 21 days after they cancel their work permit. It's totally dependent on the employer I believe though..

I'm quite sure mine is. It's from a school. The issue I have is I'm cancelling it on the 18th and I fly home on the 20th at 00:30

How can I avoid overstaying?
