Can I apply for a one-year extension of my Non-O visa based on having a Thai child without the 2-month seasoning requirement?

Hi, my non O visa expires on 30 Sept. Have a thai wife and child. Due to covid, business took a hit and as such I did not have the luxury of seasoning 400k for 2 mths. I've read somewhere that requesting for a 1 year extension based on having a Thai child only requires 400k on the day of the application itself, no 2 mth seasoning required. Is this true?

TLDR : Answer Summary
The original poster is seeking clarification on whether they can apply for a one-year extension of their Non-O visa based solely on having a Thai child without needing to maintain 400,000 THB for two months prior to the application. Responses suggest that while official guidelines may allow for this, the interpretation varies by immigration office. Recommendations include checking directly with their local immigration office and considering a temporary 60-day family extension to allow for funds to season, should the need arise.

An income declaration from the embassy can solve the money in the bank + seasoning issue.

I'm from Singapore. Not employed by any company but running own business, so it's unlikely the embassy could issue income declaration. But thanks anyway

Singapore Embassy? TKK they will do anything to help. They will tell you fly home on the earliest flight before 26th Sept.

Yup that's an option, and then there's the cost of quarantine in Singapore plus the cost of quarantine when I return to Thailand. It would be a last resort

if u suay suay (touch wood) can't get any extensions and fly back to Spore after 26 Sept, you would have to pay for the cost of the quarantine in Spore. So get it sorted ASAP or else double whammy on your wallet. 😡

MIGHT is the wording you're looking for, remember many MANY countries NEVER EVER issued the affidavit of income from abroad notary letters (Russia, China, Korea, to name just a few)

Another option you might have is to apply for the 60 day visit thai family extension for 1900baht and that would give your funds the time to season the 2 months required to get a yearly extension based on marriage. (That's IF you haven't gotten the 60 day visit family extension on this entry yet though)

Are you on a yearly extension of stay now, OR were you on a 90 day entry from a Non-O that expired a LONG time ago and currently on amnesty from that entry?

- any idea on if there is a limit on how old that thai child can be? For instance foreign parent with adult thai citizen children?

on immigration website,

"In the case of children, adopted children, or spouse’s children, said children, adopted children,

or spouse’s children must not be married, must live with the alien as part of the family, and must not

be over 20 years of age;"

I'm not on yearly extension. It's a new visa issued last year that required 90 day exit/entry. Used the 60 day extension already. And now technically on amnesty since I can't cross borders.

right then the expiration date of the VISA (the sticker from the thai consulate means nothing in the scheme of getting a yearly extension inside the country)

Think of it this way, a visa (the sticker) doesn't let you stay IN thailand, it lets you ask to get in. If they let you in they stamp you in for the length of time that visa allows <- in your case 90 days. It's that small blue rectangular entry stamp that lets you stay here and that expired MONTHS ago putting you on amnesty.

SO as long as you can meet the financial requirements based on marriage BEFORE the 26th of Sept (when this current amnesty expires) you could apply for a year extension based on that. OR as I said, see what your immigration office tells you about the year extension based on having a half thai child, OR get the 60 day visit family extension to give your money time to season.

Those are pretty much your options.

I have a Non O for marriage. It expires on October 1st but I’m stamped in until October 26th. I went to Changwattana last week to see if I could get an extension based on child. After being passed to several officers I was finally taken to a supervisor who said no. I cannot get an extension for child on my Non O for marriage. I’m getting divorced which is why i did not do extension for marriage.

After speaking yo a immigration officer friend of mine, she made a few phone calls. Apparently because my Non O visa sticker has my wife’s name hand written on it is the reason I cannot change reasons for staying.

Just my experience.

While that is the way the police order concerning yearly extensions based on supporting half thai children is written, it is more up to the immigration office as far as how they interpret it (meaning SOME offices do require the same seasoning as an extension based on marriage).

Call or go to your immigration office and check to see what's what
