Can I Apply for a New Non O Visa in Thailand to Care for My Half-Thai Child?

Hey all - question:

I entered Thailand on a Non O marriage visa last year, and later, I did a one-year extension to support spouse (had a work permit at the time). The permission to stay expired last week, and so I am now under amnesty. I plan to obtain a 60-day "visit family" extension ASAP. As I am not working at now and do not have 400k, I was thinking maybe I could apply for a new Non O in-country using my half-thai kid instead of spouse/marriage. My question: is it possible to obtain a new Non O visa inside the country if the reason for applying is to take care of Thai children? Does immigration see Marriage and Thai children guardian Non O visas as the same thing? I know that I can't apply for a new Non O marriage in country, but I was thinking maybe the kid could work -- and since I would be on a 60-day visiting family extension, perhaps immigration would view this as a type of "tourist" stay.

the rule is written so it does not require it BUT some immigration offices still enforce the same requirements as a marriage extension (400K baht in a thai bank account in your name only for 2 months before you apply) SO definitely check with your immigration office on how they interpret that extension.

There is little reason to get a 60 day visit thai family extension NOW seeing as the amnesty has been approved to be extended until the 26th of Sept. :/

Take the amnesty, figure out HOW to get the funds for one of those extensions I mentioned and when it gets close to this new amnesty running out THEN apply for the 60 day visit thai family extension if you need to so you get another 2 months AFTER the amnesty ends.

You can apply for the 60 day family extension anytime between 1 August until 25 September.

The extension would start the day the amnesty period is over.

However if you don't feel comfortable going as early as August you could wait til September.

Not the original guy you posted to, but I would love to just double check:

My Non-O expired in June.

I have wife and kids in Thailand.

I have not had a 60 day family extension yet (I do meet the req)

I would be best off waiting until the end of the grace period in Sept, then apply for the 60 day visit extension?

you're ON an O visa entry already so there's no need to nor could you get a new O visa for a different reason

Evidently you had a Non-O then you were on an extension based on marriage to a thai, and that extension expired putting you on amnesty AND you have until Sept 26th to figure out how to meet the financial requirements to get either a new extension based on marriage to a thai OR a new extension based on supporting a half thai child

BOTH of those extensions require 400K baht in a thai bank account in your name only. It's just the extension based on marriage requires you to have the money in for 2 months before you apply for the extension where as applying for the extension based on supporting half thai children requires (in theory) NO seasoning..
