Can a spouse apply for a Non-O visa in Thailand while on a visa exemption?

Good morning,

Back to Thailand.

On 15 Feb., I re-entered with my current extension based on retirement (Non-O), expiring Dec 2022.

My husband entered with a visa exempt (30 days).

Question:

Is it possible for him to apply in country for a Non-O visa (90 days) based on being a trailing spouse (dependant visa?)? And can he then apply for a 1 year extension, based on same reason ?

If possible, can he get a re-entry permit during the 90 days

Ps: we need to go out of the country early May and come back.

What documents need to be provided despite

Passeport pages with stamps and departure card, photograph, letter of the Bank and bankbook, rental agreement and location map and rental receipt past 3 months? Marriage certificate ?

Any better options?

Sadly, you can not get an in-country Non-O Visa Based on Being a Trailing Spouse to a retiree

He will have to get a Non-O Visa Based on Being Over 50 before being able to apply for a one year extension of stay based on retirement

could have applied back in France for the non-O visa based on being a trailing spouse with long stay visa but that option was “cancelled due to Covid”…

That is possible, but you will need your own 800K THB OR 65K THB a month in income OR the embassy letter

You can get that in-Country Non-O Visa Based on Retirement easily

1. The applicant’s passport and a copy of:

a. The data “picture” page.

b. The most recent visa (if applicable).

c. All entry stamps or extension of stay (if applicable) since arrival.

d. The departure card (“TM. 6”) that should be stapled in the passport.

2. The Extension of Stay Application Form (“TM. 7”).

3. A copy of the submitted Notification of Residence of Foreigners form ("TM. 30”).

4. Proof of finances:

a. A letter from a Thai bank showing that 800,000 THB was transferred into the bank account from overseas, or;

b. Twelve consecutive months of deposits of 65,000 THB a month, transferred from overseas, or;

c. A combination of both income and savings, totaling 800,000 THB or;

d. A letter from their embassy stating a monthly pension of at least 65,000 a month. If the embassy letter can be used, then the proof of the twelve consecutive months of deposits cannot be used to acquire the extension of stay.

5. A hand drawn map to the house where the applicant resides.

6. 2x passport sized (4cm by 6cm) photos.

7. 2,000 THB processing fee.
