Can my husband apply for a Non-O visa as my trailing spouse if I’m applying for a retirement visa?

Would like to seek advice here.

Husband (not yet 50) and I (50) arrived with Tourist Visa Exemption Scheme. We are planning to apply for retirement visa with husband as trailing spouse.

Went to immigration in Hua Hin and was advised to apply for non O but husband cannot apply for non O due to age.

Is that true? What’s the best way to go about it and getting our retirement visa. Thank you.

In the meanwhile, can my husband travel in and out of Thailand every 30 days without any problems?

TLDR : Answer Summary
The advice from the immigration office in Hua Hin is accurate: your husband, being under 50, cannot apply for a Non-O visa as a trailing spouse while you apply for a retirement visa (Non-O). He would need to obtain a 90-day Non-O visa issued first, then a year extension of that visa. After you secure your retirement visa, he can then apply for a trailing spouse Non-O visa at a consulate outside the country. In the meantime, your husband can travel in and out of Thailand every 30 days without issue, but he will need to manage his entries carefully to avoid overstaying.

Totally correct, you cannot apply for a "trailing spouse" Non-O visa inside the country when the person they're married to is getting a Non-O based on being over 50 😕

There's no way to do it in country 🙁

You need to get your 90 day Non-O issued then you need to get the year extension on that and AFTER you have the year, you need to find a consulate for your husband to go to so they can get a 90 day non-O based on trailing spouse to someone on a 'retirement visa'.

Your husband will get a 45 day entry stamp, can get the one 30 day extension taking him to 75 days then he needs to bounce out and back to get a new visa exempt entry OR go to a thai consulate and get a real tourist visa until you get thru the whole process to get your non-O and yearly extension so he can run and get his 90 day non-O some place
