TLDR : Answer Summary
A user inquired about the possibility of applying for a Non-O visa for their wife based on trailing spouse status while they are in Thailand on a 60-day tourist multi-entry visa. Comments indicated that she cannot apply for the Non-O visa from within Thailand. Instead, options include obtaining 90-day Non-O visas for both before arriving, or switching to a Non-O visa within Thailand and then having the wife apply for the Non-O based on trailing spouse at a Thai consulate.

The non-O could be applied online here in Thailand ? or just from abroad ?

Sadly no, your wife cannot apply for a non-O visa based on trailing spouse to someone on a retirement visa inside the country at the immigration office SO you either BOTH get 90 day Non-O visas before you come here, you based on retirement and her based on visiting family that legally lives here then apply for the year extensions

OR

You come in, switch to a 90 day Non-O, then the year extension 2 months later, and after that your wife goes to a thai consulate nearby to get the 90 day Non-O visa based on trailing spouse

thought that would be the case , looking at the Thai consulate and e visa site it looks like I can get an oa here in the uk for a year then and im assuming the drop down on the e visa non immigration, visiting or staying with applicants family in Thailand (more than 60 days) would be the correct one for my wife

@Tom ******
that is the one, you get the OA and the wife gets the O, OR you get a 90 day non-O and the wife gets the 90 day Non-O to accompany foreign family

Since this is similar to what I just tried:

I applied online for the non immigrant O Visa based on family living in Thailand. (Husband has his non O based on retirement already). Via USA Wash DC Consulate. They said not possible unless husband has a work permit. They issued me a 60 day tourist visa instead. I've entered Thailand now.

I'm still trying to figure out how to get a non O trailing spouse Visa at a neighboring country? Or is this not possible?

Thanks

seems like Penang MIGHT issue the 90 day Non-O to you based on you being married to a spouse on a year retirement extension BUT there are no reports of it being done since before covid

of fact scrub that last bit , I don’t think that’s correct , I doesn’t make it very clear on the e visa site how to add your wife
