Can my husband apply for a retirement visa extension in Thailand after it expired while we were abroad?

Hi all, hoping to get back to Bkk in the next month. Husband’s retirement extension expired whilst we were out of country 2021. He sent over the 800,000 baht [2021] can it be used for his in country application now in 2022?

I always came in on a yearly visa (applied for OS)based on his retirement visa (and had to travel out every 3 months) as he does not have this we will both be coming on a regular tourist visa at airport (30 days) what visa if any can I apply for in Bkk? Still, just, under 60.

After review your stamp, and re-reading your post a couple of times, you have the following entry options:

1. BOTH YOU AND YOUR HUSBAND ENTER ON A NON-O VISA BASED ON BEING OVER 50, AND ACQUIRE AN EXTENSION OF STAY.

This will require each one of you to have 800K THB in a Thai bank account, and have your own extension of stay. The total cost is 1.6M THB (800K * 2).

2. YOUR HUSBAND ACQUIRES A NON-O VISA BASED ON BEING OVER 50, YOU ACQUIRE A NON-O VISA BASED ON BEING A TRAILING SPOUSE.

This will require ONLY your husband to have 800K THB, and you don't need to show any money. However, this visa can only be acquired OUTSIDE of Thailand.

For both option 1 and 2, it does not matter where the funds are located; if they are located in Thailand or in your home country.

You prior had a One Year Multiple Entry Non-O Visa Based on Being over 50. This visa is valid for one year, allows entries unlimited amount of times, and on each entry allows a person to stay for 90 days. This is different then the visas being referenced above.

we’d rather not have to bring in 800x2. I have no idea what others are doing different re the trailing spouse? Have been doing this for 8 years now and every time the consulate here gives me that same visa (most frustrating), thank you both for your time and patience.

If you get that 90 day single entry Non-O visa you CAN apply for a yearly extension based being the spouse of a foreigner who is on a retirement visa. I dunno why you haven't been able to becaue many MANY people are on "trailing spouse" extensions. Your husband would need to get his yearly extension at the immigration office and then you would need to be on the last 30 days of your 90 day entry stamp. You need marriage certificates, etc but you should be able to get a trailing spouse extension that matches your husbands without too much issue.

The most easy option seems to me:

Husband applies for the Non Immigrant O visa based on being over 50 years of age and 60 days after entering Thailand applies again for the 1 year Extension of Stay.

You as wedded wife, applies for the Non Immigrant O visa based on being dependent on your husband and apply in Thailand for the 1 year Extension of Stay based on being his dependent.

You apply for these visa's before you make your way into Thailand.

apologies I don’t understand how that would work.

How do I apply for the non O here without his “retirement” visa? Previously I’ve had to hand over notarised copies of his passport/visa and a letter to get it and they would not extend it in Bkk.

Also the 800 sent last year still considered valid funds?

that’s what I got when the visa above ran out at the end of a year and attempted to extend thinking I was on a non O dependent. I was allowed in for 90 days each entry, at the end of the last 90 days I’d attempt to renew and Id get an extra month.

The only visa I saw in this post was a One Year Multiple Entry Non-O Visa (I'm guessing for being over 50). This visa allows you to enter Thailand multiple times, and on each entry allows you to stay for 90 days.

The visa I'm referring you to acquire is a single entry Non-O Visa based on being a trailing spouse. This visa allows you to enter once, on entry stay for 90 days, and allows a one year extension of stay based on being a trailing spouse to be acquired.

that was a 30 day extension of stay based on clause 2.4 tourism <- which is why it says ท่องเที่ยว

You DIDN'T get that from any entry off that Non-O visa you had and in fact got that 30 day extension from the stamp ABOVE it was a visa exempt entry (what you can a 30 day tourist stamp)

I am totally confused on this as well. I have 3 of these stamps in my passport and each coincides with the final 90 days (the fourth entry x three months) on the type of visa above non O “s” (so the older visas say)I haven’t entered with a tourist visa since 2015. 🤷🏽‍♀️

You entered on a visa exempt; a type of tourist visa, on 9 Nov 2017, which allowed you to stay until 8 December 2017. You then applied and received a 30 day extension of stay based tourism letting you stay until 07 Jan 2018.

He applies for the Non Immigrant O visa based on being over 50 years of age (populair name retirement visa) and you apply fr the non Immigrant O visa as dependent at the Thai Embassy or Consulate in your area.

most post seem to agree that applying in country for the non O based on being over 50 is best as his/our funds are not in the country of our passport.

It does not matter where his funds are to apply for the Non Immigrant O visa at a Thai Embassy. But if you prefer to get into Thailand without a visa, get 30 days but only have 15 days to get all things sorted out to apply for the Non Immigrant visa at immigration, it can be done.

ok we can do that as the funds are already there. Am I then best to get him sorted, is there anything in country that I can apply for once that is done ….. would probably have to leave and come in again as I guess by then the 30 day tourist visa would be close to up for me. Would you happen to know if you can apply for the non O anywhere or does it have to be in the country of your passport?

Okay, as you wish:

He comes to Thailand with a 30 day visa exempt scheme and applies for a Non Immigrant O visa,

You come to Thailand and use the 30 day Visa exempt scheme, apply for a 30 day Extension of Stay, leave the country and come back using the visa exempt again. If he has the 1 year Extension of STay based on being over 50 years of age (also named retirement visa) you go abroad to find a Thai Embassy to apply for the Non Immigrant O visa based on being a dependent on an alien permitted a long stay in Thailand.

Lots of different procedures and travels, but the hard way seems the way you prefer.

thank you. He applied for the first non OA in HK where we were based and funds are, but the Embassy there said we’d have to go back to Oz which is where our passports are from. Verifying funds OS for the Thai consulate in Oz required a lawyer having to certify each page (JP not accepted)and all had to be “legally bound” $$$ So as he already has the funds for last year’s renewal sitting there the requirements are pretty much what he’d have to have for an extension. Lots of photocopies -his bank book, the bank letter, his passport

oh Lordy we went with what we were told at the embassy at the time, the OA was what (obviously erroneously) we were led to believe was the “retirement”/ over 50 visa. Thank you 🙏🏼

Everything will be much clearer if you can post a copy of your visa, and your extension of stay stamps. Everything seems very confused to me, and I can't make sense of what's going on.
