Will I be on overstay while waiting for my marriage extension in Thailand?

I have an under consideration stamp for today's date (extension based on marriage). I went back today (Jomtien) and they told me they are still checking documents and to come back and check tomorrow.

Nothing was added to my passport so will I technically be on overstay from midnight? Also, I have a flight booked for Saturday so what happens if they are still checking documents when I go back tomorrow?

This is my first time doing it by myself and my understanding was that I would get my extension stamped in today.

TLDR : Answer Summary
The user is concerned about their visa status after receiving an under consideration stamp based on marriage, which is still pending approval. They fear being in overstay once the stamp expires at midnight. Responses from the community clarify that they are not technically on overstay while waiting for the extension, and it's common for processing to take longer. The user has an upcoming flight and seeks advice on what to do if their extension isn't resolved by tomorrow.

Sounds like you waited far too long. I always starts at least a month ahead

I have done 6 extensions based on marriage. 3 were inked in on rhe day specified and 3 I had to wait a little longer.

I have to admit the first time you go over the period pending it is a bit of a worry but it absolutely needn't be. You are not on overstay and your extension will be inked in. 😊

Did you ask for a re-entry permit with your extension.

Obviously can do it at airport but far easier to do both at some time.

let's not get the cart before the horse here, he's on an under consideration stamp that ran out TODAY so he can't get a re-entry permit until he actually gets the extension inked in (which hopefully will be tomorrow) 🙂

Yes but if he gets it, it would be far better to ask for the re-entry permit straight away especially as he says he is planning to leave on Saturday and he will already be at Immigration.

Planning ahead always helps.

on that we agree (y)

Once they get the extension stamped into his passport when he goes back tomorrow he should buy the re-entry permit right then 🙂

Not uncommon, and you're not actually on overstay because as a rule at the offices that give 30 day under consideration stamps that stamp is actually the first month of your new yearly extension.

BUT

you should have told them you have a flight out of the country Saturday, because if it's not approved tomorrow you can't leave or you'll lose your extension application..

All sorted today. They initially told me to come back next week, but after some sweet talking they reluctantly agreed to do it today, it took 2 hours. Re-entry permit sorted also.

Regarding the 400k in the bank, does it need to kept in there for another 3 months or or can I use it now?

you can use the 400K as you see fit, there is no "post extension seasoning" requirement for banked money method on marriage extensions
