What to do if my Non-B 90 Days Visa is about to expire during Immigration Holidays?

Hey,

Need to hear if anyone has been in the same situation and what were done about it..

Didn't get my work permit (yes, it has taken nearly 90 days to get it....) until end of this week, and earliest time i would be able to get all papers to go and change my Non B 90 days visa to a Non B visa year is next week..

NON B 90 days visa expires 31 December, so all was good when me and my lawyer checked i would go and get a 7 days extention due to the holidays... Buuuuut, last week Immigration posted it is closed tomorrow....

I refuse overstay, so i need to check with any off you if anyone been in same situation and how you potentially solved it...

Obviously i will speak with my lawyer tomorrow, but need to prepare myself to stay in Malaysia over the New Year (far away from my daughter) if there isn't any other option..

There is no, you refuse overstay, :/ Just suck up the fact that you're going to get an overstay stamp in your passport AND be thankful that you don't get the fine because of the holiday AND that you can apply for your yearly extension on Thursday the 2nd like normal.

IF you bail out of the country, you erase everything and start ALL over again from scratch..

Hi, yes the paperwork will be ready tomorrow (Monday) to go and book for the visa run... So that is the reason i need the 7 days as no trips until after New year now...

Thank u for information, it has been helpful.. Lets see what my lawyer comes up with tomorrow...

AND while it goes without saying I will say it any way

if you go to stamp out of the country AFTER your current stamp expires you not only get the overstay stamp in your passport when you stamp out you get fined 500 baht a day too :O (unless you fly out with an overstay of under 24 hours has the fine waived)

Personally I'd just resign yourself to getting the overstay stamp in your passport AND pray that who ever is pushing paper for you at the immigration office has their shit together so that it flies thru on Thursday the 2nd.

Now whether you'll be able to pull off applying for your yearly extension on Thursday the 2nd of January (the date ALL immigration offices inside the country re-open) is another kettle of fish. You are OUT of time, so the extension will either fly on the 2nd OR you're done and leave the country that day. I don't think they will even sell you the 7 day application for extension denied week to get out of thialand stamp because you went onto overstay (due to the holidays BUT overstay none the less)

I understand the difference. The company where you work for can not meet the requirements to apply for a one year Extension of Stay at Samui Immigration, this has nothing to do with Immigration rules but with the way the company you work for is set up.

I just wrote to make it easy, visit on 2 Jan 2020 the Immigration Office apply for the 1 year Extension of Stay, as your company does not meet the requirements the application will be NOT Approved and you will get a stamp and 7 days to leave the country, in which you can plan a visit to a Thai Consulate to apply for a new Single Entry Non Immigrant B visa.

I'm not sure they would get the 7 day application not approved stamp to get out of thialand because they already RAN on overstay. That's gonna be totally a judgement call by the officer they're in front of when they apply for their extension I think.

I have had people with only a single day overstay (not due to a holiday though) denied that 7 day "get outta dodge" stamp because they ran over before they applied for it

here's what the stamp looks like you get in your passport (AND as you can see this was over the new year break too)

IF your current stamp expires on a day the immigration office is closed (weekends or holidays) AND you go the very FIRST day they are open again you will NOT be charged for overstay BUT you will get an overstay stamp IN your passport. it will say Overstay xxx days fine waived holiday.AND you will be able to apply for your extension like normal..

OR at least that is my experience with holiday closures and immigration offices ALL OVER thailand.

A bit of side point.

That 7days is not really extension, it's called "extension application denied" stamp,, usually grace period to leave Thailand. It's not extension anymore, some will but not all immigration offices allow you to apply for new extension during that period. you need to check.

I guess you missed some posts and comments.

If the Immigration Office is closed for weekends or official holidays and during these days your Admitted to Stay ends, you are allowed to visit on the first working day and apply for an Extension of Stay without being fined for overstay. I would say prepare all the documents and visit 2 Jan the Immigration Office and apply for the 1 year Extension of Stay based on working inside Thailand.
