What should we do if my husband's Non-B visa extension is still under consideration the day it expires?

Urgent question:

Husband has Work Permit and had Non B visa. Went to immigration got 1 month extension under consideration (the time they need to check the docs) The 1 month finished today. HR say they called Immigration and that in Bangkok they have not finished checking the docs yet?!

So he is not getting his 1 year extension today...but no problem.They tale care.

How is that not a problem?

Should he not get another stamp for "longer" checking ? As per his Passport he is only allowed to stay until today. What now?!

Should he go to Immigration now.

that happened a few times with me and it is ok because it is in their side that they did not finish. It will not take weeks or months. If longer they will stamp for another month. Sometimes it is just the communication not relayed. Hope you can get the good news early next week.

, I would make the trip to the immigration office and check in person if the paperwork is back or not. I wouldn't take the word of a trouble causing HR person about it. Especially seeing as you're leaving the country soon and need that year extension so you can get a re-entry permit after that.

They don't do anything if it takes longer,

He's not on overstay he's waiting for his approval to come thru.

Sorry, mixed the names. Yes, as long as he is back with a valid re-entry permit before the Under Consideration date stamped in his passport.

Please note, I am not the OP but my husband is in a similar situation. I was just seeking clarification about Tod's earlier comment.

My question (as simply as I can) is: If the Non B extension process takes a month or more, is it possible to leave the country while the process is ongoing?

Not in your case, as you stated before: His Admitted to Stay period with the under consideration stamp finished today. So you have to wait till the Extension of Stay is inked in his passport and directly apply for the re-entry permit to keep it alive when travels.

Sorry if I wasn't clear - my question is more about whether it's possible to leave the country while the 3 month SE Non-B is being extended to a 1 year ME Non-B?

The re-entry permit is used to keep your Admitted to Stay period valid, so you also have to be back before this last date. F.E. Admitted to Stay 31 May 2018, with re-entry permit leave and come back before 31 May 2018 and you get stamp Admitted to Stay till 31 May 2018. If come back after 31 May have to start whole process again.

So if I understand you correctly, if you are still WITHIN the 'admitted to stay' date and have a re-entry permit, you can leave the country and it won't affect the process of extending the SE non-B to a 1 year ME?

The re-entry permit is valid till the Admitted to Stay date and you past that date already. You can not get a new re-entry permit based on that the application is still under consideration.

Honestly it is not all that uncommon, BUT if you're at all concerned you can go to your immigration office and check with them. They don't re-stamp it and I remember a few years ago when it was flooded out at Chaengwattana that people who had 30 days under consideration ended up really being 60+ days before they went back and got their year inked in

OK I understand that things can take longer... thats fine but shouldnt they put a note or smtg in the Passport. We are flying to Europe im 2 weeks ... then what will happen at the airport? He needs to get a re entry etc.

You HAVE to get the yearly extension BEFORE you leave the country or you cancel everything and start over at square one.

I had they same problem, I went to the imm office on the 30th and was told Bangkok had not sent the email saying the documents passed, a few hours later the imm office phoned me and told me they had the email

It happens more that due to amount of work Immigration can not make all the checks in this one month under consideration period. It is not a problem and you won't get fined. But on the other hand I always like to hear that from Immigration and not from a HR employee. You can call Immigration and ask yourself to be sure.
