What steps should I take if my work permit expired while I'm on a Non-B visa in Thailand?

Hi everyone, I’d really appreciate some advice 🙏🏻

My work permit expired in March, and I didn’t realize it at the time. I’m still working with the same company, and my Non-B visa is valid until May.

Has anyone been in a similar situation?

Could you please advise me on the proper steps to resolve this issue and how I should proceed?

It’s obvious it’s a new non-b which means you haven’t been working long under this visa did you ever have a WP ??

Did you pay your taxes during this duration if yes then apply now you should be able to get it

You are already on overstay visa since the day your work permit expired. The best and correct way is for you to leave the country and come back with a new Non-B visa, start every thing all over again. However, if you will apply a new work permit, the old one has to be cancelled with Department of Employment even though it was expired, but your old WP data is pending in the system. Your company, director and you will be fined for not cancling WP within 15 days after its expiration. I recommend you hire an agent to help on this.

You shouldn't have to do anything if the company you work for consider you a valuable employee you go into the HR department and let them know. They should have known when your work permit expires should be in there files sounds to me a company with a little care for the employees

Thiri Htun Shwe I hope you get this sorted out it sounds like the HR department isn't very good at what they do. When I was working there were two companies I worked for and all I ever had to do was sign papers they made sure everything was filed all the documents were accounted for and fees paid. Too bad all companies don't operate like this

First question is are you actually on a Non-B visa or an extension of stay based on working, check your passport. If you are on an extension of stay you are nominally on overstay since the moment your work permit expired and have been working illegally since. If you're on an actual visa ignore the overstay bit.

March is not that long ago though so I'd see if the company you work for can quickly get you a new work permit

Thanks 🙏 I checked my passport, and I’m on a Non-B visa, not an extension of stay.

Since this will be a new work permit, is there any chance my current visa could be affected or cancelled, and would I need to leave the country and apply for a new visa, instead of doing an extension?

no, if you are on an actual visa it won't be affected. Get the work permit before the visa expires (as quickly as you can really) and then you should be able to apply for an extension as normal

Your visa would be ok but if it is an Extension you have been on overstay since your work permit finished
