What should I do after my work permit was canceled and I started working at a new school in Thailand?

Good day!

I'm a new member to this group and I've read some posts and understand how the work permit and Non-B visa is linked.

Here is my question, I resigned from old school and they took my work permit which was cancelled by them without me last Monday (@ Lamphun MOL)! I still have my Non-B visa which expires on 18th Sep 2022 and thought it would be ok to stay until then. (New school told me the same thing) but just realised that It' not. (After I read some posts here, i think I need extension)

The old school went to Lamphun MOL and cancelled my work-permit and had never issued me a receipt. The director of the old school called the new school several times and embarrassed me, told them not to accept me. But, the new school tried calling to Lamphun MOL and trying to apply new one. What would be the best option for me to get this done? I believe the seniors here would be of a great help to me. 😃

I gave one month notice to resign (on my 3rd month of probation) and an official resignation letter to them but old school didn't accept it. Am I overstaying here? This monday would be already a week after the cancellation of work permit.

I already started working with the new school in Chiang Mai. Shall I go to the Chiang Mai immigration office tomorrow or Lamphun's one? The new school is trying their best to assist me and said they can handle it, asked me 25,000 Thb to apply a new one. But, I wana make sure it all went well without having problems here. There are 2 (two) different things.

a Visa which gives you 90 days of stay and can be obtained from an Embassy or as in this case inside Thailand by conversion.

an Extension of Stay for 1 year based on employment.

The 90 days you get using a Visa can not be cancelled if you do not work or stop working, you can stay until the last day of the 90 day period.

an 1 year Extension of Stay must be cancelled when the reason why you have this Extension change, like you get 1 year to work but you stop working.

As Lloyd already showed, this visa is based on working with mentioned school, you have to talk to your new employer, get all the documents ready to apply for a NEW Non Immigrant B visa at a Thai Embassy. Use that new visa to enter Thailand, pick up your new work permit and you are good to go work.

Highly appreciate your answer Robert.😃 my previous visa and work permit with the old school was the 3 month one which I paid 5,000 baht. It would expire on 18th Sep. Like you explained, I think it's not a problem right ?

Correct, you have to 18 Sep to collect new documents to apply for a new visa at a Thai Embassy. Check their websites for all needed documents and prepare with your new employer before you travel.

Only an extension would expire when a work permit is cancelled. Since you are still on the visa entry and haven't done an extension you can stay till the visa expires.

a work permit is yours alone, same as your passport. You should never have given up possession. I've never lost a job or cancelled my work permit, so I don't know. But usually a receipt if given would be taken to immigration to cancel the extension? Which in your case doesn't happen. Hopefully someone with direct experience can answer, or the person who actually took your work permit to cancel at the labor department.

If you already started working, you're working illegally.

The school won't care that you are working illegally and will tell you it's fine, as they won't get in trouble if you are caught. Only you get in trouble.

As for staying until 18 Sept, yes that is fine, it just that you can not work on that visa anymore.

Thanks. It's been almost a week since the work permit book was cancelled. I never know my visa would be expired since that day. I was in immigration a few days ago showed her my passport and asked lady officer. She said I still have visa and not a problem. Will go and see her again tomorrow.

First thing, you can not use that visa for your new school, it says under the visa the name of the school that it was issued for. So you might be better doing a visa run to a nearby embassy and getting a new Non-B there, then come back and apply for the work permit in your new location.
