Hi I'm confused about my visa situation, I have Non-B visa base on employment which expires on 6th Jan 2021, work permit expires on 11 Nov 2020, my company I was working for can not afford to renew them, they didn't cancel it for my convenience, so what's my best option if I would like to stay in Thailand? (Getting a job would be ideal unfortunately no luck yet) TIA!

TLDR : Answer Summary
The user is confused about their visa situation in Thailand, specifically regarding their Non-B employment visa expiring on January 6, 2021, and a work permit that has already expired as of November 11, 2020. They are seeking advice on options available to stay in Thailand, especially since their employer cannot afford to renew these documents.

Do you have a visa (almost always a full page sticker) or an extension of stay (a half-page stamp that says "extension of stay")?

Your extension of stay based on employment is valid no later then:

1. The date stamped in your passport, OR;

2. The date on your work permit, OR;

3. The last date you worked

Depending which date is first.

Legally, your extension of stay based on employment ended on the last day you worked, and you've been on amnesty since. You need to cancel your extension of stay based on employment and work permit, and go to your local immigration office and get an amnesty stamp for 1,900 THB. You should be able to stay in Thailand for an additional 60 days.

Thank you for your advice, does that mean I need to get it done before 31 Oct, correct?

Can I cancel the extension of stay based on employment and work permit by myself or need the company to do that?

your employer must issue a letter of your employment termination —it automatically cancels your work permit. After that you should get the letter and go to immigration yourself to cancel you visa. Good luck!

The work permit and extension of stay are your stamps, and it's something you can do. Different immigration offices have different requirements.
