I have a question - Husband DTV approved in Australia.

Long story short - we have lived in Thailand doing language ED visa for last year. My husband cancelled his ED before leaving Thailand to go to Australia to start the DTV application. That was 2 weeks ago, and it was approved. YAY! So now is where my confusion starts…..

I am now going to fly over with the kids to do our part. I was meant to go to Immigration and get the extension for our education visa on Wednesday (4th June) I’ve advised the school, that I will be leaving on 10th of June to go to Australia so would like to cancel the education visa.

They are saying I’ll have to pay 5000baht now to do the extension for 90 days and then they can cancel the visa aswell……..

Would my education visa not just be cancelled when I leave the country???

I’m so confused
Answer summary
The user is facing confusion regarding the cancellation of their education visa (ED) in Thailand before moving to Australia, where their husband has received DTV approval. The conversation reveals that the user should officially cancel the education visa with the school to avoid complications, as leaving the country does not automatically cancel the visa. There are financial implications as the school is requesting a 5,000 baht fee for the extension and cancellation. Various commenters share their experiences and advise that it's crucial to handle the cancellation appropriately to ensure a smooth process when applying for the DTV visa.

I suspect your not actually on a visa at all but an extension of stay based on education. A visa can't be cancelled, an extension of stay must be cancelled but you can probably do so after you return to Thailand. You need to get the DTV before you return as you can't get it inside Thailand

OP
My extension of stay then will be over on 15th June. I leave on 10th of June - the. I should technically be able to apply for my DTV after the 15th with no issue? We will be applying with my husband as our sponsor - his DTV is already approved.

Appreciate your guidance and support

you can apply for the DTV on the 10th of June if you like but you still have to cancel your extension of stay. Whether you do so before you leave or after you return is up to you, it reaching it's expiry date doesn't cancel it, it remains valid in the immigration office system until such time as you go and cancel it with paperwork from your school.

Yeah - with the “non ed” visa we had to be at immigration twice every 3 months - for extension and then stamps - so I feel like - it was just a “work around”

So once we leave / the “Visa” will be non void

your not on a visa your on an extension and leaving doesn't void it from an immigration office perspective, you need to cancel it

My school advised me to cancel the visa. I didn’t have to pay anything, and I went to the immigration office here in Chiang Mai with the cancellation documents.

The school told me that after 3 months of classes, it was mandatory to cancel the visa because it would remain active even if I left the country, and that could cause problems when re-entering Thailand later.

Even so, when I was leaving Thailand, an immigration officer stopped me and spent around 10 minutes checking my records before letting me go.

But when I entered Thailand again with the DTV, I had no problems at all.

You can't have an active visa when you apply for the DTV. The ED needs to be cancelled. It wont automatically be cancelled because they don't know if your on vacation and coming back. It's a shame you can't leave to Australia earlier.

yep, the issuer of the first visa needs to cancel it on an agreed / fixed date. In my case I gave my passport to the issuing company a week before the end date and they got immigration to set a cancellation date - stamped in the passport. I then collected it a few days later and got my new 60 day stamp on a border run.

But there is no re entry permit for the Ed Visa / nor in my passport?

I'm not sure about that but it's in the system regardless

OP
Yeah it’s not very clear cut - 3 visa agents have told me once we leave without a return-entry permit it is automatically terminated, but then the school I suppose airs on the side of caution, but the caution cost is expensive haha
