How can I change my working visa extension to a marriage-based extension in Thailand?

Greeting everyone. I have some questions of changing working visa extension to visa extension based on married to a Thai. I hold a Taiwanese passport and currently on visa extension based on employee, applying in One Stop Service in Chamchuri Square. I am on the notice period of resigning, and my hr will make an appointment on 12th of January for visa extension cancellation. I will get married on 4th January, already have a confirmed appointment in Bang Rak District Office to get marriage certificate.

According to my hr, I have to cancel my visa extension in One Stop Service then go to Chaeng Wattana to apply for new extension. Does that mean I have to do both in the same day? Thanks in advance.

Okay I think what has eluded ALL of us (or at least me ๐Ÿ˜› ) is that the O/P is a FEMALE foreigner married to thai national, and in that case there is no proof of 400K baht for the Non-O visa in country OR the year extension. <- the must be married 2 month rule still applies though (because that is immigration office dependent)

They should GO to the thai consulate in Savannakhet Lao and get the 90 day Non-O visa based on marriage, come back get stamped in for 90 days, wait 2 months and then go apply for the yearly extension at the immigration office in Bangkok

As a simple answer, you cannot apply for your extension based on being married to a Thai as you planned. You have to leave Thailand and enter Thailand on tourist status or Non-O based on marriage to a Thai from the embassy/consulate outside Thailand.

This is because Bangkok doesn't allow you to apply for a visa/extension based on being married to a Thai national unless you have been married for a minimum of 2 months.

Just as information in case you have been married for more than 2 months as of application day for marriage visa/extension.

Technically you have to apply for cancellation on the last day and you need to apply for a new extension on the same day not to overstay.

But generally, you may have a 'margin' until the application of a new extension

- at most immigration offices let you apply for cancellation of an extension several days earlier

- as BOI/IEAT employee, you MIGHT be granted 0,7,14,21 days grace period to prepare to leave or apply for another extension. You need to check with OSOS how many days you could get.

Thank you for your reply. Then In the case of entering Thailand on Non-O based on marriage. Do I still need to wait for being married for 2 months until apply for one year extension? And I will have to apply it 45 days before the Non-O expires?

in theory you can apply right up to the expiry date of the Non-O but you'd be better applying a week or two before in case you are missing some requirements

, that varies by consulates/embassies. Check the requirements on the web of the consulate/embassy where you can apply for a Non-O visa. You need to check the consulate carefully to see if you can apply there for sure

, you have the when you have to apply for the extension part wrong

At Bangkok and some other offices you CAN apply when you have 45 days or less left on your current stamp, you don't HAVE to apply (other offices allow you to apply when you have 30 days or less left on your stamp)

You can get the Non-O visa at a thai consulate outside thailand, come in, get stamped in for 90 days, WAIT 2 months and then apply for the year extension when you have 30 days or less left and then you'll be fine even if they have a 'must be married 2 months rule'
