Can you provide advice, please: a 42-year-old male has lost (or had stolen) his 2 Western passports and has been living without a visa and job, depending on emergency help from his parents. What is the best and most economical way for him to legitimize his stay, get a job, and even rehab? He's currently in the Bangkok area.
Answer summary
A 42-year-old male in Bangkok has lost his two Western passports and is living without a visa, relying on emergency help from his parents. The best steps for him would be to first contact his embassy for assistance with obtaining a replacement passport and addressing his visa overstay. If he can, he should involve his parents in this process. Following the passport issues, he will also need to seek help for any personal challenges, including addiction. There are suggestions for him to look for job opportunities once he stabilizes his immigration status.

This man should try to get friends and family to help him pay off the overstay and fund a ticket home. If this is not an option he should first reach out to the embassy and see what solutions are available. The addiction obviously needs to be dealt with but taking care of the passport/ overstay issue is the first concern. Then getting help for this addiction. Just my two cents

He doesn't have any other options but to get advice from his countries embassy on what he needs to do to get an emergency passport to leave the country.. He may have to file a police report to satisfy the embassy for passport replacement but I would ask thier advice first because presenting to the police on overstay is likely to get him arrested and put in immigration detention.. And he will still need assistance from his embassy anyway.. So talk with the embassy first for advice.. Trying to find a way to legally remain in Thailand will be impossible now and the longer he delays it the harder things become and penalties just get bigger..
Charmae *******
Sounds bs to me sorry why haven't they gone to the police or the embassy?
Alastair ********************
Until the loss/theft is reported to police the embassy will not help. The embassy will not under any circumstances circumvent legal requirements. The issue this person has, from what I can see, is they have for whatever reason overstayed their visa. The only way it is this is too surrender to immigration/police either at the boarder or domestically. They may have motivating circumstances as to why they have overstayed but whatever that train is the fact they have breached their visa conditions still remain. Sorry and good luck.

Because of the terrible FB format, I can't see if you've answered what is CLEARLY uppermost in so many commenters' minds: whether or not the guy is on OVERSTAY. So, forgetting those who have NO IDEA,,,,,,,, whether he is or not on overstay,,,,,,,,,,, if it were me, the first thing *I* would do is go to MY EMBASSY, and see what they say,,,,,,,,, you know, since their JOB is to help and protect their citizens. Then follow their advice.

Personally i would go to embassy first see about the rules about this, If the embassy can do emergency travel document get it buy a ticket asap (guess he needs help with that) go to airport pay 20.000 fine (help again ) and go home, will be blacklisted but no time in immigration cells

Get married to a Thai that wants to live in his home country. Once everyone has visas divorce. Or do what I used to do. I hated visa runs so I would go to Malaysia border stamp out and pretend to walk to Malaysia but turn around and walk back in with no stamp. I'd stay running my business under the table then when I needed I'd go back to the border sneak out and go stamp malay and come back to Thai for 30 days haha I did visa runs 2 times a year for 12 of the 15 years there. So he can walk out sneaky like but Thai immigration police are stupid and lazy so it's easy. Walk out go strait to Malaysia police and say it was stolen right then from a guy wearing a brown shirt and you don't know what to do and the Malaysia police will do the report and let you go the tour embassy. Get a new passport which will have a new number and start all over new because Thai immigration can not fathom the idea of a new passport number. The problem with the passport number is what caused me to learn to sneak by and do my trick. Good luck

There's really only one answer...go to the embassy and get an emergency passport. Tell them the situation and hopefully they will help him get home.

Depending on the overstay...might catch a fine and be blackballed from ever entering again, but at least it will be better than jail 🤷‍♂️

There is one word this worries me, rehab, means he has a drug or alcohol problem. It sounds he is in Thailand quite a while and overstayed for a longer time. The only way out of this is get sober, go to the embassy and ask for help. I would avoid the police, because the will find out about the overstay and he will not leave the Police station on his own. Don’t worry about the cost because it will cost. But it will be much cheaper than going to jail in Thailand and wait for deportation. Only my opinion.

He's going to be sitting in IDC for a long long time unless he gets travel documents before he turns himself in at immigration. He'll need a plane ticket flight direct to his country, 20,000 baht in cash for overstay fine, and he'll need to make it to the airport immigration with travel document or passport.

Вітаю пане Богдане. No chance in Thailand for him to legitimize his stay, get a job, the worse think he will have problems in the future travel to Thailand. This is a critical situation that requires immediate, careful handling to minimize the risk of arrest and prolonged detention. Because he is currently overstaying without a passport, job, or legal status, he cannot simply apply for a job or a visa right now. He must follow a strict, sequential legal path to regularize his presence or arrange a controlled exit.

Resolving Legal & Passport Status (Most Critical)

He cannot be hired or join a private commercial rehab program while actively on an illegal overstay. If stopped by police before self-surrendering to immigration, he faces immediate placement in the Immigration Detention Center (IDC).

1. Obtain a Police Report Immediately: He needs to go to the local Thai police station closest to where his passports were lost or stolen. He must report the loss of both Western passports and obtain an official, stamped police report. This report is his temporary "shield" to show he is actively resolving his identity.

2. Contact His Embassies in Bangkok: He must schedule an urgent appointment at his home country's embassy or consulate. Using the police report, he needs to apply for an Emergency Travel Document (ETD) or an emergency passport. Embassies usually issue these quickly for citizens in distress.

3. Address the Overstay at Immigration: Once he has the emergency travel document, he must present himself at the Central Immigration Bureau (or the main immigration office handling overstays in Bangkok).

• The Cost: The overstay fine in Thailand is 500 THB per day, capped at a maximum of 20,000 THB.

• The Reality: Because his overstay is likely long, paying the 20,000 THB fine will be mandatory. Furthermore, because he is surrendering with a long overstay (over 90 days), he will be subject to a re-entry ban ranging from 1 to 5+ years upon departure.

• The Best/Economical Path: The safest and most economical strategy is a controlled voluntary departure. He should use emergency financial assistance from his parents to pay the 20,000 THB fine and buy a one-way ticket home. Attempting to get a "new visa" inside Thailand after a severe overstay without leaving is generally impossible

CapableBlueberry6460 pretty sure you will be given the yellow pages treatment by the police for overstaying.

Even if you are one day over and you are unlucky enough to run into the police, pretty sure you will be put in jail until you can pay for your ticket home.

It a very difficult situation your friend is in but I would explain to the embassy before the police. Bound to have been others in this situation in the past.

The moment he "lost" his passports, he should have immediately gone to the embassy to get an emergency passport. And leave the country before the visa or permit to stay expires. The moment he went into overstay, he is liable to get checked and arrested by Thai police and deported. Now he is already on big trouble and there is no way he can even hope to find a job. He needs to get his papers and surrender or go to the airport and pay the overstay and hope the immigration do not escalate

Lynnette Munoz no, he is in a catch 22 situation with no simple solution.

He cannot leave without a passport and cannot go to the police to get a report that allows him to get a passport replacement.

In saying that, he may be able to just apply for a passport and in most cases it will ask where your old one is, you can normally list it as lost rather than stolen and I don't think a police report would be required.

He needs to report his passport lost or stolen to the police and contact his embassy for a new one, which embassy will depend on which passport he entered Thailand on.

Is your friend also on overstay? In which case it's probably best to try and avoid the police, contact the embassy and see what they suggest. Overstay is a serious issue and if caught on overstay he will likely be arrested, deported and banned from Thailand
