I have a Non- Im B Multi, I want to apply for a one year extension of stay based on marriage, (I know about the money in account/income requirement etc) I believe I have to exit and re-enter on another type of visa, what’s the exact process for this. Work permit expires mid Sep (being renewed) visa in mid Oct. also 😬 how will it work as far as my WP is concerned? As far as if it’s issued whilst under one visa, will it be valid under a one year extension based on marriage or will I have to do/declare/apply for or modify anything?

TLDR : Answer Summary
To apply for a one-year extension of stay based on marriage with a Non-IM B Multi visa, you must first exit Thailand and apply for a single-entry 90-day non-immigrant type O visa at a Thai consulate. After receiving the visa, return to Thailand and get stamped in for 90 days. Within the last 30 days of your stamp, you can then apply for the one-year extension while meeting the necessary financial requirements. Your work permit renewal should be coordinated; it typically remains valid if issued while on the previous visa, but it's advisable to check specific regulations regarding modifications.

Exit the country, go to a Thai consulate, buy a single entry 90-day non-immigrant type O Visa, come back, get stamped in for 90 days and when you have 30 days left on that stamp apply for the yearly extension by meeting the financial requirements.

It will go under consideration for 30 days and then you go back and get the year extension stamped into your passport

That’s good to know, in the unlikely event of my wife and I parting in the future I’m thinking it would be prudent to go down the dependant path. I have the funds, have held the same job for a government school for almost two years. Maybe I should try the dependant extension first.

BUT having said that I HAVE seen the immigration office issue yearly extensions to a foreigner who had a thai child with their at the time thai g/f and who then married them at the Amphur.

The ONLY difference between a yearly extension based on marriage and one based on supporting thai children is that the 400K baht doesn't need to be seasoned any length of time for extensions based on raising children where as for ones based on marriage it needs to be seasoned for 2 months before your application

yes I’m familiar with that process, it can be six months plus assuming you have the consent of the mother. I was just thinking that if my extension was based on my half Thai son that this would be a constant in the situation where my marriage might not necessarily be, if you get me.

, it's 100% up to the immigration office on that one. Legally <- as in how the law is written, when you're not married to the thai who has your child you get no parental rights granted and even subsequently marrying them doesn't confer any to you without going thru family court and getting your parental rights legally recognized.

I wasn’t aware that the date of birth was an issue, thanks for clearing that up 👍

only temple/home village married at the time of birth. Later married at the Amphur. I guess that options off the table then?

In order to get an extension of stay based on having a thai dependent <- which I will take to mean based on being the father of a half thai child the question IS was your child born while you were married to a thai or when you weren't married to a thai?

IF you are wanting to apply for a yearly extension of stay based on marriage at the immigration office like you originally stated yep you only need a 90 day single entry and then you get your documentation and financials together to go apply for the extension of stay like I outlined previously

Just to confirm Tod, that would be a single entry 90-day Non-immigrant type O visa based on marriage to a Thai? Also I’m considering ultimately going for an extension to stay based on having a Thai dependant.. (not linked to my marriage) what are the pro’s and cons/what would you do?

that’s brilliant, thank you for your clear advice 🙏🏼

, you can hold a work permit on a Non-O visa/extension based on marriage so you're fine.

You won't start doing 90 day reports until AFTER you get your yearly extension.

Thank you Tod, I assume then I just have to do a 90 day report to local immigration then? What about my work permit, will this remain unaffected, or is it linked to my visa type?
