Can I let my current visa extension based on marriage expire and then return to Thailand to apply for a new Non-O extension?

Morning people.

I am on a year extension of stay based on marriage and my visa is based on my business and work permit earnings meaning I don't show the lump sum every year.

If I was to leave Thailand and my extension of stay runs out do I just come back on a single entry non o and then reapply for an extension of stay based on marriage again but just show the lump sum this time?

This is based on the fact that my business will most probably close.

I understand that it may not be easy to get back into the country for a while as I will have no visa or work permit.

I just want to know that it's OK to just let my current visa run out but then come back and reapply for a new extension of stay process?

TLDR : Answer Summary
The user is currently on a year extension of stay based on marriage and asks if they can let this visa expire while leaving Thailand, then return on a single entry Non-O visa to reapply for an extension based on marriage later. Responses suggest applying for a new 90-day Non-O visa upon return and then reapplying for the extension of stay before the new visa expires. Some commenters emphasize the importance of obtaining a re-entry stamp before leaving to simplify the process.

Get an extension before it expires. Then apply for the re-entry stamp. It's better than dealing with the embassy later. Even more requirements.

he may be out too long to get a new extension of stay. He can only apply for a new extension either 30 or 45 days in advance; depending on the immigration office

Get a re entry stamp and leave. Then you can come back and apply for another extension. Too much hassle now for visas at the embassy.

That doesn't make sense. Once his extension of stay expires, he'll need a new Non-O visa based on marriage to a Thai national to enter Thailand.

I meant that he should do it before it expires. To save the trouble of dealing with the embassy.

the question was based on if it runs out not if I do it before I go. I have been around long enough to know that

This is Thailand and you should never ever let your visa expire if you stay here long term. Especially now when it's difficult to deal with the embassies. You never know if you can get back in.

if you were to be out of the country when this extension of stay ran out, you would indeed apply for a new 90 day Non-O visa based on marriage to a thai and then when that 90 days is running out apply for a new yearly extension of stay.
