Are there any specific requirements when applying for a 90-day, non-imm type O (visiting Thai spouse) visa? And, has anyone successfully switched from amnesty to this visa type within Thailand?

TLDR : Answer Summary
When applying for a 90-day non-immigrant type O visa based on marriage to a Thai spouse, specific requirements must be met. It's crucial to determine whether you're seeking this visa type or an extension of stay based on marriage. Additionally, transitioning from an amnesty status to a Non-Immigrant (Non-O) visa while in Thailand necessitates first obtaining a 60-day family extension, as you need a valid visa status for the application process. This is because the application for a Non-O visa requires real days remaining on your existing stamp, which isn't possible under amnesty conditions.

The ONLY way for you to go from amnesty to ANY type of Non-Imm visa inside the country is to first get a 60 day visit thai family extension to put yourself back on a "hard stamp extension".

That is because in order to apply for an in country Non-O visa you have to have REAL days left on a stamp in your passport because the application for an in country Non-Imm visa goes under consideration for a period of days before you go back and get it inked into your passport (Bangkok and other areas it's 14 days, Chiang Mai it's 20 days

You can't do that on amnesty because it's is NO stamp, (in fact looking at your passport you're on overstay because all amnesty is, is the ability TO overstay your stamp with no penalties or fines).

SO step one is GO get a 60 day visit thai family extension based on marriage to a thai to get you OFF amnesty,

THEN once you get that get your funds together, get your documents together and when you have 30 days or less left on that 60 day extension go apply for an in country Non-O visa based on marriage. It will go under consideration and then you go back and get the Non-O visa and a new 90 day stamp inked into your passport

@T**
does the 60-day extension require 400k in the bank?

@Harry ******
when you apply for the Non-O visa you will have to show proof you transferred 400K baht into a thai bank account in your name only from abroad. (There is no seasoning or length of time this money has to be in the account).

@Harry ******
nope, the 60 day visit thai family extension does NOT require proof of funds at all

@T**
so in order to get the 90 day stamp, 400k in a Thai bank account is required?

@Harry ******
THEN after you got the Non-O and go back to apply for the year extension you show that the 400K baht has been in your account for 2 months before you apply for the year extension.

You will get a 30 day under consideration stamp (during which time they usually do an in home visit to make sure the marriage is real) then you go back when that 30 day stamp expires to get the year extension inked in. AND some offices ask you to bring your updated bank book to show the 400K is still in the bank at that time too

@Harry ******
in order to apply for the 90 day Non-O visa you need to show 400K transferred into your account from abroad

is it a must the money be transferred from abroad? Or what if the 400k is transfered into my Thai bank account from a Thai bank account, is it possible to get the Non-O visa based on marriage?

First question first as different answer is already given:

What do your want?

1. Non immigrant O visa based on marriage

2. Extension of Stay based on marriage
