TLDR : Answer Summary
Yes, your husband can apply for a Non-O visa while on a tourist visa in Thailand, provided he meets the necessary requirements. He must have at least 15 days left on his tourist visa for the application at most immigration offices, or 21 days in some locations. It is advisable for him to obtain a single-entry tourist visa before travelling to Thailand to ensure he has enough time to gather the required documents for the Non-O visa.

Thank you very much. Unfortunately he doesnt have 21 days ๐Ÿ˜… he will need to travel back to work after 2 weeks in Thailand. I guess he definitely need to get it from here before we leave.

It just that he will be in and out every 6 weeks and it kind pain in the arse to get tourist visa everytime he visit :(

Visa fee for non-O in this country is almost 10 times higher than in Thailand.

, If his typical schedule is something like that, it might be kind of hard to get in-country Non-O then following 1-year extension based on being married to a Thai national. They both apply under-consideration period of 30days, which means the applicant has to return to IO on that specific date.

One of the ideas might be considering multiple entry Non-O visa for the same reason.

definitely get the year long multi-entry Non-O visa if you can then because it will perfectly suit the travel plans of your husband.

have him buy a single entry tourist visa from the thai consulate in his country before he comes here, that will give him 60 days and that should be plenty of time to be able to get the documents together to apply for the 90 day Non-O visa at the immigration office

If he is on Tourist Visa and meeting all requirements for an in-country Non-O visa, he can. Applicant needs to have at least 15 days (at the most immigration offices) / 21 days (Chaing Mai or a few other province offices) remaining with the stamp when he applies for an in-country visa.
