Am on a non-Imm O (marriage visa, multi-entry)

I entered Thailand just before the visa expiry date and received a 3 month permission to stay stamp.

My visa has expired, my stamp has one month remaining still.

What would you say my best options are?

Wait, or get some sort of extension now?

I need to be able to stay here with my kids, I live here.

Pls no "you don't live here you just have permission to stay lectures" thank you.

TLDR : Answer Summary
The poster is currently on a Non-Imm O (marriage) visa and has a three-month stay stamp that has one month remaining, but their visa has expired. They seek advice on whether they should wait for an extension or apply for it now to remain in Thailand with their children. Various comments suggest options such as applying for a 60-day extension for visiting family, which could be done depending on specific immigration office policies, or the possibility of obtaining a one-year extension based on marriage or having Thai children, although financial requirements must be met.

Go to your local immigration office and ask for the handouts.

I also have a 90 day multi entry non O from Savannakhet, Laos and also get 60 day extensions from Samui immigration. I do not have the requisite 400,000 baht for the usual extension of stay based on marriage or child. My visa expires on 1 May, so I need to return to Laos to apply for a new one year visa. I've just emailed the UK embassy to ask if they will issue a letter, similar to the COVID tourist extension letter, for UK expats in this situation, so we can apply at our local immigration office for an extension. However, to date, Thai immigration have not included this situation in their rule relaxation changes.
@Tod ********
, do you know if this is likely to change? Thank you.

@John ********
I see you did...from samui

@John ********
have you done an extension yet?

1 May, so there is chance things will change. If I get any guidance from the UK embassy on this specific issue, I'll post it on here. Cheers.

It seems that immigration feels that people who decided to get year long, multi-entry Non-Immigrant Type visas (where they bounce every day) was a decision that person made on their own AND at this time there is no provision to give those people the 30 day unable to travel due to covid-19 extension whether they have the embassy letter or not.

When does your current extension expire?

At least you have until May on the VISA so if the borders do open up you can bounce

okay lets try to sort this out because people are confused.

Think of a VISA <- (that you get at a thai consulate in another country) as a pass that lets you ASK to be let into the country when you show up here.

If they decide to let you into the country they HAVE to let you in for the number of days that visa allows. In the case of a Non-Immigrant Type O visa that is 90 days

The rectangular blue stamp you get when you stamp in is what let's you stay IN thailand. AND whether the VISA expires or not, the ENTRY STAMP is valid and what let's you stay IN the country.

Many many people on year-long, multi-entry Non-O visas bounce out and in every 90 days and just before the visa expire bounce out and back one last time taking the actual time they spend IN thailand on that visa to about 15 months (in 90 day increments)

NOW if you have the Non-O visa based on marriage to a thai (or raising half thai children) you can go to your immigration office and get a 60 day "visit thai family" extension for 1900baht

Keep in mind SOME immigration offices let you do this once per ENTRY <- meaning you could get the 60 day extension on ANY of the 90 day entries you make on your Non-O visa

BUT

SOME immigration offices only let you do it once per VISA <- meaning you can do it ONCE on any of the 90 day entries you get while the visa is valid but then not get it again until you get a new visa from a thai consulate.

Check with your immigration office to see how they enforce the rule,

As I understand you can get a 60day extension on your current stamp.

I’m sure one of the admins will keep you right. 👍🏻

60 day visiting family extension or go for the 1 year extension based on marriage, with evidence of 400k in the bank for 2 months OR based on having a Thai Child (must be the legal father).

The marriage visa has expired. I did a border bounce just before it did, and received permission to stay for 90 days.

I believe I can not get a 1 year extension on a visa that has already expired.

@Michael *******
1 year extension requires 400k weather its based on marriage or having a child right?
Gregor **********
if you were issued a Multi Entry Non-Imm-O based on marriage, it must be a 1-year visa. Otherwise since you say you got 90 days permitted stay, it must be a Single Entry Non-Imm-O visa. Okay, and "whats about getting extensions of stay" comes down on the finances. For an application for a 1-year EOS you either got the required 400,000 THB on your Thai bank account for 2 months, or you can prove 12 months of money coming into Thailand from abroad 40,000 THB per month. That's the financial requirements next to a few others (proof of marriage status etc)
Gregor **********
at least you can buy some more time when you apply for the 60 days based on family relations, but you cannot start an application for an EOS with a Non-O based on marriage out of this extension
Gregor **********
if you got the 400K THB on your account, you can apply for the Extension of Stay based on marriage on your Immigration inside Thailand

Same issue as me from what I understand you get 30’days with the letter from embassy regardless of visa but that’s just what been reading on other posts.

The notices I have seen from the immigration office explicitly mention tourist visas only, so I have no idea where I stand right now.

Honestly? I'm expecting the virus to overrun immigration staff soon and for them to just announce an amnesty. It's ridiculous to have people queuing up in Imm offices right now.
