Is my Non-B multiple entry visa still valid if I leave Thailand before my amnesty expires?

Hi, I currently hold a Non-B multiple entry visa valid from 19MAR2020 until 18MAR2021. My last entry stamp expired on 17JUN2020. I'm now on amnesty until Sept 26. I have a work permit that's valid until 29MAY2021.

I understand all my current, limited options to remain in country on this current visa and none of them seem financially feasible. I'm now giving serious consideration to going back to the US when/ before amnesty expires on the 26th.

My question is this: Even though my last entry stamp expired on 17JUN2020 if I leave on/ before amnesty expires, is my visa technically still valid until 18MAR2021? In other words if I returned to the US Sept 26 and returned two months later, for example, would I receive a new 90 day stamp and my current Non-B ME visa retain its validity until its original expiration date?

This is an extremely difficult decision to make and I would hate to return to Thailand only to find out my visa was invalidated because I was on amnesty. Any advice would be much appreciated. Thank you.

I would retain my work permit while gone which does put me on the list of people allowed to enter the Kingdom.

Not all who hold a Thai work permit are allowed to return.

When you are working, you can take a vacation. The length of the vacation is between you and your employer. You are also free to go anywhere you want on your vacation (as long as your employer approves)

However, IF you leave Thailand, it is unknown how long it will take for you to be able to return. In some countries, flights to Thailand only run twice a month :O

yes, that’s what makes this situation even more difficult. I have no misconceptions about how difficult or costly it may be to return even having a work permit and valid visa.

Please make sure you are eligible to return to Thailand.

And returning in two months may be in doubt. Prepare to be away longer.

And the costs to reenter are expensive...review carefully.

Hi, James. Yes, I have an extremely ill relative (not COVID related) at home as well plus a family who can use the support of me physically being there. Because of restrictions, and quite frankly, the difficulty of getting back into Thailand once I leave, I've postponed going back since March. The decision to return would not be made lightly and I'm doing my best to evaluate it the situation from all angles given my visa difficulties. Agreed about being able to return in 2 months hopeful at best.

Difficult decision...but with unknown return and accompanying costs in doing so...might be wise to stay.

Same issue here. I cant apply for extension of stay as company is temporarily closed until October and dont have ss receipts for last few months. If borders open, would I be able to return on my valid multiple entry non b visa still? Or would you require additional paperwork to still use a valid visa?

Why not apply for an Extension of Stay based on employment? If you leave you might consider to cancel the work permit and avoid tax and sso still have to be paid.

. Yes, I've looked into that. The Thai employee requirements for a Non-B ME visa are one Thai employee for one foreign employee (which is what we currently have). To apply for an Extension of Stay (1 year) the requirement is four Thai employees for one foreign employee. We are considering expanding our business eventually so we can hire the required employees for the extension. The only problem, which I was just informed of last week, is all four Thai employees need to be employed no less than three months (having SS and insurance registered as paid with the government) before applying for the extension. We don't have the time in which to meet the requirement by the 26th. Agreed about being able to save money by canceling the WP, but having a WP also qualifies me to return to Thailand whereas tourists, etc. cannot now.

A multiple entry visa is just that; a multiple entry visa. You can leave and return to Thailand as many times as you want on this visa, as long as it is valid. On each entry, you'll get 90 days.

ASSUMING You qualify for re-entry due to COVID-19, you can return until the validity date of the visa without any problems.
