My Thai wife needs to go back to UK as been back in Thailand almost 2 years and to keep her UK visa to live and work there

Does anyone now how long she needs to stay in UK to keep it legal as don't want to go back for long

Does she need to stay 3 months, 6 months, year

Hopefully someone has done before

Thanks
Answer summary
The discussion revolves around the requirements for maintaining Indefinite Leave to Remain (ILR) in the UK for a Thai spouse who has been outside the UK for nearly two years. Key points include that there is no fixed duration she must stay after returning, but she should demonstrate a 'genuine return' with proof of ties to the UK, such as utility bills or bank accounts. Repeated long absences may risk revocation of ILR, especially if it appears she is using ILR merely as a means to travel. Generally, being outside the UK for more than 2 years leads to automatic cancellation of ILR.

I should have added, if you are living in the UK, do you have a house, job what are you tiess to the UK family and other factors will make immigration decide are you living in the UK, or gaming the system by coming back a few months every 2years,if you are spending more time in Thailand than the UK, then they may well decide you are no longer living in the UK, immigration at airports have the power to cancel the ILR, on the spot

There is no time limit when you have ILR, but it is assumed you are living in the UK. If you leave for 2years come back a month or 2 then go back to Thailand fir another 2 years you risk having your ILR taken away, they expect you to be living in the UK, at what point they decide you are no longer living in the UK, is not published,

Just open a little thai cafe and get her a skilled worker visa as a thai chef/cook look at all these corner shops/asian general dealers thats what theyve been doing on the basis of speaking pashtun or peshwari etc.

No fixed period to stay after she returns as far as I know, the rules say a 'Genuine Return'. I don't know what qualifies for that but when she comes back, it would be a good idea to get her name on a council tax bill, bank account, utility bills etc.

Phil Wilson i though that pay some bills monthly etc .she has the visa so what does it matter if ahe works in rhe UK or not she is his spouse a d as we all know he definitely has to go back or still have some investment in the uk cos who knows with thailand. I hope she dont have to come here .

Ronnie Jasper Hey, I don't make the rules! It matters because if Immigration suspect that she only returns to reset her visa, they can revoke it. In such circumstances they may ask for proof of a genuine return. Until she obtains citizenship it doesn't matter that she is the spouse of a British citizen or not. When the original visa application was made, she will have signed to say that she intended to live in the UK permanently.

seem to remember reading conditions of my wife’s citizenship was 180 days each year in the country for the 5 years before the citizenship

was granted . it may have changed but it was a residency before citizenship was granted . won’t be doing that again total nightmare

If she wants to stay in Thailand,

Do the proper thing and let her stay there .

Don’t abuse the system

Leave it for honest people !

Malcolm Ferguson Hang on. There's a legal time to stay in the UK, so you can basically stay in either Country. No abuse of the system. What's your problem with that?

Important point - does she have ILR? The rules are different for those with and without ILR.

Joni1828 I will leave the above in place as you may have read it and then not read any edit. I think you can ignore the bit about visa start dates - that applies to pre - ILR. In your wife's case with ILR its 2 continuous years outside the UK. Her ILR is automatically cancelled after 2 years. Sorry for the confusion. I would remind you though about her being considered as abusing her ILR. I know this because my ex (with ILR) was questioned after several long stay trips back to Thailand. They didn't total 2 years and were not continuous but the officer told us that if he felt she was using ILR as a glorified tourist visa, he could revoke it.

Joni1828 Ok well the 'rules' state that she cannot be out of the UK for more than 2 years but as I say, if its suspected that she is actually living abroad, she may be questioned and if they are not satisfied - denied entry. I understand it rare but it can happen. Note also that the start date for calculating the 2 years is the start date printed on her visa - not the date she actually entered the UK. People have been caught out that way.

Agree with Colin Chaffers. There is no fixed time - if her history, at any time up to gaining citizenship, indicates that she's actually living abroad - ILR can be revoked - note CAN BE. I'm not suggesting your wife is doing this but what UK Immigration will say is that ILR cannot be used as a long term tourist visa. If she's already been out for nearly 2 years, its possible that she may be questioned on arrival. Be prepared.

Literally enter the country and it resets, they are not very rigorous in applying the rules with this but it can happen. In theory once she's out 2 years her visa or indefinite leave to remain is invalidated

There is no fixed time. However, the visa is given on understanding she is intending to live thier permanently.

Colin Chaffers I understand that but if we went for one month would be allowed another 2 years, as we do intend going back long term in a few years, thanks
