Does my 15-year-old stepson need a guardian visa if my wife has a Non-O visa while I apply for a Non-B visa?

I’m applying for an education visa for my 15 year old step son (son of my wife). Got an international school lined up.

I’ll be applying for a Non immigrant B work visa and work permit and wife is eligible for a non immigrant O visa as a dependant of mine.

My question is does the 15 year old student require to have a parent on a guardian visa or can my wife be on the non O visa?

The non 0 visa would be a better option for us.

I’ve heard that he can not as he is not my biological son. He is my wife’s son of her previous marriage. Would make life allot easier if he could be classed as a dependent

sorry I missed​ this fact. Yes he would​ need to be your legal child to qualify for dependent visa
