Can I change my O visa based on marriage to a retirement visa in Thailand?

Last year I started having problems with my Thai wife and I went back to UK for 6 months to work as I usually do, I came back on a 90 day O visa based on marriage.

When I arrived back I found out she has left my home with all her possessions , I have not seen her for the 3 weeks I’ve been back and can only communicate via messenger.

My question is I would like to change my visa to a retirement visa, I’ve got the 800,000 in the bank now.

Is this possible and how would I do it?

I don’t want to try for 1 yr marriage visa because I think we could soon be divorced.

Please no sarcastic comments I’m going through a hard time at the moment

Tricky.

You have to void your OA visa by leaving Thailand.

Then return and apply for a 90 day non immigrant O. Based on retirement.

After 60 days can apply for an extension for one year . Then every year after just apply for extension of stay without leaving Thailand.

LISTEN.

If your current OA visa is a multi entry visa leaving Thailand will not void it. When you come back in to Thailand you will be stamped back in as being on that existing marriage visa.

You need to come back in to Thailand on a tourist visa or 30 day visa exemption. Can apply for tourist visa at some nearby country of your choice if your not eligible for 30 day visa exemption . I left on the day my visa expired so my visa was expired and came back in as visa exempt. Then immediately applied for 90 day non O.

If you have long time left on current visa and don't want to wait for it to expire I am not sure what to do. I think, you need to check this, that when you apply for a tourist visa from outside Thailand this application automatically cancels or renders void , your current O marriage visa.

Then apply immediately like 2nd or third day back in Thailand. for a 90 day non immigrant O visa based on retirement. Assume you over 50.

Then after 60 of the 90 days is gone apply for a 12 month extension of stay.

I converted mine from marriage to retirement several years ago. I did it directly with immigration, no agent, and it was pretty easy - had to do the usual copy, copy, copy, etc, but not difficult. Good luck to you, the sun will shine again.

Hi, I have kept the same non o visa for years now and extend every year. I used to extend based on being the mother of a Thai child. When it was time to renew I renewed based on marriage with the same visa just a different reason for extension. Not sure if it’s different for retirement etc but that’s my experience, no need to leave Thailand or change visa.

You are right because when you have a Thai child the situation and requirements is in favor of parents, alot easier compared to other category of visa even small Bank statement for few days is acceptable at Visa renewal time. In case of obtaining a retirement Visa even amount is 800K and but have few other restrictions as well.

U need leave< if u have the 800,000 in the bank ,head to Phnom Penh or laos and get a new 90- day non o ( dont need go home)

come in an than get the 1

OR IF ur money has been there 2 months + and came form overseas<

head to any border , come back in on a visa exempt and convert to a NON o and than ur 1 year

It is easy to change. Just let immigration know you prefer it, as it is easier. I changed, as I did not like the hassle of the marriage visa.

You can only change to retirement if you are already on a 12 month extension and are renewing. If you are on a 90 day Non-O marriage Visa you cannot switch to retirement, but you may wish to ask your Immigration Office if it is possible as they are all different.

I simply told them I no longer had interest in a marriage visa, since they were asking for me to jump over too many hoops, and wanted to simplify my life with a retirement visa. They told me that is what we would have suggested! Very simple process to change.

Your question was "is bribery illegal?" and I provided a link to show that it is. It doesn't bother me that cheap farangs are throwing tens of thousands of baht at agents. My extension costs 1900 baht per year and is 100% legal. All I was doing was pointing out that many "agency" visas/extensions are obtained by paying off immigration officers (ie. bribery). I already said I don't use the 800k method, I choose the 65k/month method because I don't want to tie money up. Is it that difficult to understand? Plus my visa is 100% legitimate and if required I can produce my bank book showing the required funds.

Unfortunately you cannot extend a visa you received for one reason with the purpose of a different reason. What that means is that you'll need to leave Thailand and return, you don't need to go home to get a new non-O visa though. Just leave Thailand without a re-entry permit so your visa is nullified, and then return visa exempt. Then you can apply for the non-O visa based on being over 50 instead of the non-O visa based on marriage.

You should find the paperwork requirements to be quite a bit easier than the marriage visa and extension, but regardless you'll want to go to your immigration office shortly after arriving and ask for their list of requirements to convert to the non-O based on retirement. Then gather what they want and apply soon after since you must have 14-21 days left on your entry stamp depending on the office you use.

when you are already on yearly extension you can change the reason from for example based on marriage to being based on being over 50.

What you cannot do is change the reason for the first year extension. The first one *must* be for the same reason the original 90 day non o was granted.

the information Brandon, Chris and John have given you is correct. You can do a border bounce without getting a re entry permit. Then you enter Thailand receiving a visa exempt stamp on arrival which gives you 30 days. This you can extend with another 30 days at an immigration bureau in the country. An agent can do it for you if you don't want to travel to the immigration office.

Within this time you'll need to get all your paperwork sorted as you'll have to apply for a non-o 90 days with still at least 15 days left. After those 90 days you can apply for the one year retirement visa.

Using an agent is highly recommended, immigration often does not like having to put too much time into getting you to understand what papers the Thai government requires as it's a lot. I've never used an agent and never had a problem. You can get a list of requirements from the immigration office which serves your province or area. You use this as a checklist and ensure you have the required documents. It's really very easy. The only people who say it's difficult are those offering "help", which always comes at a ridiculous price. I know people who pay up to 20,000 baht for a 2,000 baht visa. Stupidity at its highest level
