Currently on a Non-Imm-O, based on marriage. Will turn 50 a few days before the expiration date of the current extension. I prefer not to wait for the last minute and apply a few weeks earlier - can I apply for an extension of stay based on retirement before I am actually 50 ?

TLDR : Answer Summary
You cannot apply for a retirement visa extension until you turn 50 years old, as the regulations specify that this extension is intended for those who are over 50. It is advised to look into alternatives, such as requesting a 60-day family visit extension based on your marriage to a Thai national, which can provide additional time until you reach the age requirement for the retirement extension.

49 years and 360 days isn't 50

Nope you cannot,

That extension is issued for the real reason of "กรณีใช้ชีวิตในบั้นปลาย" <- which says in the instance of living out the end of your life 😮 (now you see why they call it "retirement" in english 😛 )

and

there is a clause that says มีอายุเกิน 50 ปีขึ้นไป <- be 50 years or older

They won't let you switch to that extension until you hit 50

Now you say you're on a yearly extension based on marriage to a thai national, so you might ask them if you could get the 60 day visit thai family extension and that could "buy you the time" until you turn 50 so you could apply for the year extension based on retirement after that 60 days winds down

Thank you for your answer. In case I submit the application once I am 50, and use the income route (65,000+ per month) with an affidavit certified by my consulate to testify for that, what does Immigration expect regarding the content, or detail level of such an affidavit? Do we have any examples available?

IF your consulate here indeed issues the affidavit of income from abroad notary letter they will know exactly how it needs to be worded,

Believe me you aren't the first foreigner to ask for one (IF they issue them) 🙂

am I correct in saying that option is only available to OP if he has previously not used a family visit 60-day extension on this current visa (original visa and all previous extensions)??

good question

Correct, it's a "one and done" type of extension and you can only get it once on any visa/extension

So if the O/P has gotten it before on this extension they're on now (since they started with it from the Non-O visa) they couldn't get it again..
