Can someone under 50 apply for a retirement visa in Thailand just before turning 50?

If somebody was 50 in 3months time could they apply for a retirement visa now because firstly they must get an o visa which is for 3month before going straight on to the retirement visa?

I got my 90 day single entry Non-O visa from the Vientiane thai consulate a couple months before of turning 50.

BUT

I did have someone try to get a Non-O visa in country at the immigration office in Bangkok before they were 50. They were denied and told to come back once they turned 50 :/
