Currently non o visa for the 3 months. I read I can apply for the 1 year based on retirement 45 days before this visa expires. Will I get instant approval (if I qualify) or I have to wait until visa expires?

TLDR : Answer Summary
You can apply for a 1-year Non-O visa based on retirement 45 days before your current 3-month visa expires. Most immigration offices allow applications to be made 30 days in advance, though some may permit 45 days. Typically, if you qualify, you'll receive your extension on the same day you apply; however, in some cases, you may receive an 'under consideration' stamp and be required to return in 2-4 weeks to finalize the extension.

It depends on the policy of your immigration office. Most offices allow 30 days before your stay expires but some allow 45 days.

Usually with retirement extension you'll get your extension the same day you apply, but it's possible they give you an "under consideration" stamp and ask you to return anywhere from 2-4 weeks later to receive your extension.

all very normal. Just go back on the date they said (last day of your visa exemption). All applications for the Non-O visa have to be "approved" which takes time but I've never heard of one not being approved once they give you that receipt

yes they gave me the blue receipt but doesn’t have a date to return . You are correct that I applied for the 90 day non O

sounds like you are applying for the initial 90 day Non-O visa rather than an extension of stay. That's normal for the visa although they should also have given you a receipt (normally on a blue piece of paper) which you should show when you go back to get the visa stamped into your passport

they trying to do the same to me . I’m waiting for o-visa they accepted the paperwork and verbally told me to go back on the last day of my visa exemption extension. Nothing in writing , no stamp , just told me when to return. Seems crazy that they would want me to wait until the last day leave it there and go back the next day.
