TLDR : Answer Summary
The post discusses the possibility of applying for a Non-O-A visa at the Thai consulate in Penang. It clarifies that a Non-O visa is available, typically meant for those over 50 seeking retirement, but emphasizes that the Non-O-A visa cannot be obtained in Thailand or at S/E Asian consulates; it requires home country application. Key documents required include proof of funds, background checks, and possibly insurance. The application process is outlined, including duration and appointment requirements.

Generally speaking your husband will need to get his Non-O visa which he should be able to do inside Thailand. Once he gets his 12 months extension of stay you should be able to get a Non-O based on being married to him in a nearby country. AFAIK you can't get a trailing spouse visa based on retirement inside Thailand

Fab, thanks guys

Pay close attention to this comment. You will NOT get a trailing spouse Non-O visa issued inside the country based on your husband holding a "retirement visa"

As john said your husband needs to get their Non-O and then the one year and AFTER that you can go to a thai consulate in another country to get the 90 day Non-O based on marriage to a foreigner on a "retirement visa"

May I ask if you are age 50+ ?

How long have you been in Thailand?

Do you have many COVID extensions or other kinds of visas or visa exempt entries in your passport during the recent two years of COVID ?

I ask this as Penang is looking at your recent history of staying in Thailand when considering the granting of a new Thai Visa.

Koh Phangan

@Tyler ********
Koh Phangan CANNOT do it, you slog over to Samui OR to Surat Thani <- the head office for your province to get the Non-O and the year extension

We both entered from Bali on a tourist visa about 2 weeks ago and can extend for 30 days at the local immigration office - do you reckon that will suffice or do we need to bounce?

@Tyler ********
again I say... please ask your Thai immigration office for their list of requirements. It's possible to get the Visas you are wanting inside Thailand in most Thai Immigration offices.

Hi James, we’ve got the funds in my husband’s thai bank account (Kasikorn), yes. So do we need to go back home to apply, or no?

, Check the general requirements for in-country Non-O based on being over 50 from here. You need an exact list from your immigration office, but you can get a rough idea of what you need. Again, this is for the main person only as commented below, a dependent needs their own visa from a consulate outside Thailand.

ask your Thai immigration office for their list of requirements for the Non O Visa as retiree and you as trailing spouse. It may be possible to do it in Thailand.

Hi James, my husband just turned 50 and I understand that me being under 50, I can piggy back through the marriage certificate. We both need to do the paperwork. We were in Thailand for portions of COVID but came and went a couple times, all within the legal parameters of their temporary COVID extension grants.

@Tyler ********
You both may need to do a border run to get a NEW visa exempt entry into Thailand...

Giving you both 45 days stamp plus one 30 day extension of stay. During which time you work with your Thai immigration office.

@Tyler ********
the OA Visa is ONLY available in your home country.

As
@Tod ********
related...

If you are able to meet the financial requirements of transferring internationally 800,000 to your husband's name only Thai bank account... then you both need to ask your Thai immigration office for their list of requirements for him as the Non O Visa as retiree and you as his trailing spouse.

I think you are really asking for a 90 day Non-O <- (no A after the O) visa based on being over 50 so you can get a year extension based on retirement once you're back.

You can get the Non-O visa issued IN country by meeting the proof of funds 800K baht in a thai bank account in your name only transferred in from abroad, (some immigration offices require those funds to be seasoned 2 months before you apply some don't)

You'd also need a minimum of between 15 and 21 days left on your current visa exempt or tourist visa entry stamp or an extension from one of those to apply

You apply at the immigration office pay your 2000baht, the application goes under review for 2 weeks or more, you go back get the Non-O visa and a new 90 day stamp inked in, then when you have 30 days or less left on your stamp you apply for the year extension for 1900baht. That's how it's done in country.

Now whether you can or can't get a 90 day Non-O visa in Penang is unknown, their website links to the requirements to get the O visa from KL. There is no appointment process at Penang it's a walk up consulate.

I would say you could try it OR get ahold of
@Jim **************
who pre-covid used to push a LOT of paper down at that consulate and see if it's still available and what the requirements are

You are correct, Tod, non-O into retirement visa. Perhaps my best way forward is to go to immigration and confirm they can do it here (and what paperwork they need).
Tod *********
I can confirm 100% you WILL NOT be able to apply for a Non-OA visa at ANY Thai consulate in S/E Asia 😮 You get an OA visa from the thai consulate in YOUR country before you wing your way here. It's the visa that requires the police background check, the medical certificate, proof of funds and the mandatory 3 million baht insurance policy 😮

Are you saying I must go back to my home country to transition from tourist to retirement visa?
Mikkel *******
@Tyler ********
no, you can get a 90 day non o either in Thailand or in a nearby country. You can then apply for a 1 year extension in Thailand at immigration after. A 1 year non OA (notice the A) can as
@Tod ********
points out only be acquired in a country where you hold residency or your home country. In any case a non OA can not be obtained inside Thailand.
Tod *********
NOTE: on the oft chance you hold legal residence in any country here in S/E Asia (as in have a long stay visa or what ever they require to prove you're a resident of that country) you can use the thai embassy/consulate to apply for the OA visa.

It's only available from the thai consulates in your country of passport origin OR a country you hold legal residence in. Other than that, nope, you can't get one issued.
