Why was my OA visa application denied based on income verification despite my husband's approval?

My husband and I applied together for OA visa from USA. He was approved but they don’t seem to want to approve my income. We are going to live off his pension ( covers both of us for required monthly income) and I have large retirement account but too young to remove money without penalty. Any thoughts? Calling embassy is not helpful.

You would have to show you own proof of funds and I'm sure they're not wanting to let you use his pension as proof of funds for you.

You could apply for the 90 day Non-O visa (because spouses of Non-OA visa holders can get a Non-O visa under the trailing spouse clause (it says so on the consulate where the OA requirements are listed)

If you are going the Non-O trailing spouse 90 day visa route, get your marriage certificate certified by your state (marriages are NOT certified by the federal govt, but by the state that issues it, THEN you send it to a thai consulate (Chicago, LA, Washington DC or New York) to get it stamped by the thai Embassy <- you will need to do that BEFORE you come to thailand or they will not recognize the marriage in thailand and the US embassy here doesn't certify them anymore.

It's 100% the embassies call on the proof of funds so you are stuck. If you want the Non-OA yourself you have to meet the proof of funds yourself, that's just how they're interpreting the rules for that visa

Sorry for the hijack of the op question but I have attempted to take the steps you outlined. Non oA for me and non o trailing spouse but was told by Thai embassy that we need an resident address in Thailand before they can issue non o for spouse. How do we get rental address before we even get to Thailand? Many thanks

that is between you and the consulate you're dealing with

I never heard that, most people put the hotel they're staying at as the address

many thanks for the reply. I asked the embassy how we would have lease contract before arriving in Thailand and they stated they don’t have any advice but it’s a requirement to have address of residence which I took as a lease and not hotel address. Thanks again for responding

OO Edward you can indeed show funds in your country for the OA and the OX visa

Keep in mind you get 2 years of stay out of an OA visa so if you're going to get a year extension AFTER that you will have to transfer the funds but it's a ways down the road, and you could always go the monthly income route and just transfer 65K baht a month in for a year before you extension

here's a silly question. Could one apply for a Non-O in home country showing funds and indicate retirement as the reason, then enter Thailand and apply for an extension based on trailing spouse with the correct trailing spouse documentation?

as a rule NO, they usually put the reason you applied for the visa on the visa itself

AND

you have to get ONE extension based on the reason you got the visa

So if you're comin' in on one marked retirement you couldn't apply for a trailing spouse extension off it

yes Non-OA which I applied for in Washington DC in 2021. Just needed to show the balance in the account. They didn’t ask about the tax consequences of withdrawing the funds.

nope, I would say they won't

all you can do is apply with those documents and they'll email you if it won't fly
