What Are the Visa Options for My Dad in Thailand Given His Medical Situation?

Hi. Just wanted to post here off topic, because it's an emergency and I want to know if anyone else has this info or is in the same boat. (information needed BEFORE the 27th of July). I posted on Bangkok expats and was told here would have more resources to answer:

My dad has a heart condition and used to work for a well known University here. He retired this year and so his working visa was cancelled and he normally has been given by 27th of July to leave the country. His flight is booked for the 26th. However, we looked on the website and it said that there is an amnesty extension for tourists and foreigners in Thailand due to the ongoing covid situation. It has not been made official if this applies to all foreigners, not just tourists , and we do not know if my dad falls into this category of those allowed to stay until the 26th of September.

It's weekends and a long holiday and so all offices are closed, but the reason we didn't act before was because before we thought that he would be able to stay thanks to the visa extension announcement.... But now that information has mysteriously been removed from the Immigration website completely. It has disappeared and we don't know what to do. With his heart condition, if he catches covid, he won't survive.

I need urgent urgent advice. Please help. We need the information before he is expected to board the plane on Monday.... Is he allowed to stay? Does anyone have info?

I keep getting slightly different details in info from different people so I thought I’d ask if any one is SURE what the thing is.

This is what was in the paper about the REMOVAL of the official bureau statement :

A draft copy of the proposal for the visa extension request, which was approved in full, was posted on the main Immigration Bureau website. However, as of this afternoon the announcement posted has been removed. (See here.)

Of note, while the extension of the visa amnesty has been approved by Cabinet, traditionally it takes several days for the Immirgation Bureau to draft and publish its own actual order to bring such amnesties into effect. That is expected in the coming days.

Called by The Phuket News earlier today for clarification and confirmation of the visa amnesty extension, Phuket Immigration Deputy Chief Col Nareuwat Putthawiro was unavailable for comment.

not sure about the emergency, it is 26 today, he board the plane on 28 July but you want him to stay inside of Thailand?

There are not many seats on planes available so just for a few extra weeks, i would say do not gamble, unless your father is in a medical situation that he can not fly safe, If that is the case he needs to see his doctor at the hospital for documents to show immigration

we have a plane booked but he has a heart condition so it’s not safe to fly and we will get his doctor to write a note when we can if we can do it when everything reopens on Wednesday 🙂 yesterday he experienced chest pains but not enough to go to the hospital

yes I am aware of that but so far he hasn’t gone to the hospital for a request and we can do so in the future if it will help him, but right now are focusing on figuring out if he should go or not if he’s allowed to stay past the 31st

So you want us to choose if your father want to go back home country to see his family or that he has to stay inside Thailand,

no no no. I am here to seek advice as to whether his particular case is INCLUDED in the amnesty as I have heard different things from different people. I’m not asking people to help decide anything... merely inform me on what they know.

And yes I know he should make his own decision. I am just trying to do research and be a good daughter....

there is no "grace period" they were amnesty decrees, the first one from March 26 to April 30th, the second one from March 26 to July 31st, and this current one from Aug 1st to Sept 26th.. It's not a grace anything, it's a "you can legally overstay and not be fined or penalized" sort of thing.

- This one has been referred by both press and government to as “Grace Period” to suggest that “this is it” It differentiates it from the amnesty in peoples perception. Whilst they might both have the same legal weight and designation. “You have time to make plans now, leave, convert or acquire a visa” please. I think maybe a British English rather than American English thing? “Grace” entirely appropriate here, hence its frequent use in the press. make sure he cancelled his EXTENSION OF STAY and not just his work permit because

there is HUGE difference between letting an extension run out (which doesn't officially cancel it) AND going to the immigration office with proof you cancelled your work permit AND the documents from your former employer to cancel an extension officially.

He NEEDS to cancel the extension officially at the immigration office.

thank you! I’m sorry I’m not really clued up on these matters, but could you clarify what an extension of stay entails? All I know is the uni helped him shut down his permit and went with him to Chang Wattana before the amnesty and they said he had to leave on the 31st of July

So I don’t know if that counts that he cancelled what an “extension of stay” is

okay IF they cancelled his work permit AND then took him to Chaengwattana <- the immigration office there is a good chance they DID cancel his extension already.

IF that's the case then he's covered until the 31st of July on the current amnesty AND he'll be covered on the new amnesty until the 26th of Sept, <- BUT keep in mind that amnesty that's good until the 26th of Sept is specific, you either FIND a way to stay past that date (doctors/hospital letter, embassy letter, etc) OR you leave on or before it.

I think because he’s American, that’s where he’ll go... it’s the only place he has a house and he’s not very good at going places on his own. Ideally I’d love for him to have a nice holiday until this all dies down a little, but he just wants to quarantine somewhere with family by his side. Thank you for your suggestion though 🙂

Everyone who does not have a visa can stay no longer then September 26. IF they desire to stay longer, they can either:

a. Get an extension of stay based on medical reasons or;

b. Acquire a letter from the embassy saying they can not get flights back to the home country due to COIVD-19, for an extension of stay based on COVID-19 (note: very few embassies will issue that letter).

If he gets an extension of stay based on medical reasons, he can stay an additional 30 days. I assume he can get as many extension of stays based on medical reasons as required.

I haven’t seen it 😢 he keeps that stuff to himself unfortunately. I’m just trying to last resort find a solution so he doesn’t have to go... because right now he is scheduled to leave but will stay if he is sure he’s allowed to

If your father is not working, he should have cancelled his work permit and extension of stay based on employment, so he could have gone on amnesty.

yes he’s cancelled it, so is the automatic amnesty definite for his case, and does he have to report to Chang Wattana when it open? (Ps thanks so much for helping to answer)

If he cancelled his extension of stay, then he's on amnesty. There's nothing else he needs to do if he's planning on leaving by September 26
