Hi, I need help please

I resigned at my job last 30th of October. We agreed to cancelled on Nov. 13, as I orchestrated my flight and come back with Tourist visa.

The HR cancelled my WP through online stating that my last day was Nov. 1. She submitted yesterday and still processing, stated "in review". Now, my problem is my visa. She was supposed to cancel my WP on 13th of Nov. as what we agreed.

Should I leave the country now? My plan is to fly to Vietnam, however this situation got changed.

My previous workplace is too far from Bangkok so as with the immigration that stamped my Non B. Is it really necessary to go there to cancel? Or can a cancellation letter (sent thru pdf) would be suffice?

The HR admitted thatxshe doesn't know anything about the process.

Is there anyone knows an agency that can cancel my visa? Or what should i do?

you should get 2 pages from your employer that you take to immigration to cancel your visa. Your work should do it, but normally if you quit, they wont or as you said, they dont know how to. tell them by email to contact immigration to find out what documents you need to cancel your passport - if they dont do it you at least have the email to show you tried, and work did nothing to help you.

You need to cancel your visa by yourself. Cannot do it by agency becoz they need yoir passport for stamp

You have to go to Bangkok to cancel the visa in your passport, otherwise it will affect any other visa you will apply for again in Thailand

Also, you need a cancellation letter from your company stamped or signed from your company stating the date your employment was cancelled

Canceling work visa and work permit are at different offices. To cancel your work visa you need documents from company which company must handle it for you. As long as your work permit is not cancelled (pending in the system) you are still ok. But once cancelled and you are still in Thailand, you will be on visa overstay.

It looks like you are on an extension of stay based on previous comments. The only way to cancel your extension of stay is to visit the immigration office that issued it, it being too far away isn't an excuse. If you don't cancel it you will technically be on overstay which could impact you if you ever want a long term visa/extension in the future

You should properly cancel your visa before leaving Thailand to avoid retroactive overstay fines or future complications when applying for a Tourist visa or any long-term stay.

Because your HR logged November 1st as your last working day in the online Work Permit system, your Extension of Stay tied to that job legally expired on that exact same day. Even if the Work Permit cancellation is currently "in review," your visa status is now vulnerable to overstay.

Who is your employer, if I may ask -- if it is an "employment agent" rather than the actual employer, things could get especially tricky, in multiple ways (I have heard SO many stories, especially from English teachers at that school that I left in 2019 -- My UNIVERSITY was OK, possibly because it never used third-party recruitment agents -- But at the PRIVATE HIGH SCHOOL where I later taught for a few months, third-party recuiters (employment agents) were frequently used, and I heard LOTS of complaints about therm

People who have not been in Thailand or who have never had a work visa (meaning a private or government employer) will probably be lost -- simply give it time and learn from others' experiences and expertise, as I am trying to do -- and if you ARE employed and are feeling lost, option 1 would be to go to your local immigration or labor office and discuss things with them, and I think option 2 would be to PRIVATELY contact one of the more compentent contributors to this discussion (not me, because I just told you I am learning from this discussion) and ask them to recommend some visa agents who would be competent advisers in this type of situation

Did you have a 90 day non-B visa, or an extension of stay?

If you had a visa, you don't need to do anything. If you had an extension, then yes you must cancel it. I'm not sure why you're relying on your employer to do things for you. They have zero incentive to help you. It is YOUR work permit, you should be the one canceling it. And it is YOUR extension and you need to be the one to cancel it.

If you don't cancel your extension, you might be blocked from getting a different long term visa or extension in the future until you cancel it. And you'll be charged 500 baht per day up to a maximum of 20,000 baht for failing to cancel it.

And that's why I recommended that the Original Poster discuss matters with his local immigration officer, even if he needs to bring a Thai friend along to make discussion matters clear in both directions

Edwin Zehner Apparently, the HR did it online and now waiting for it to be cancelled and head to immigration for final step. My problem now is I'm in the island, when it gets cancelled I might pay for penalty.

And I guess the relevant POINT of my story is that I had NEVER felt like my Work Visas and Work Permits were in my control -- The employer always held all the cards and at one point even tried to take my passport into custody (though maybe I am mis-remembering someone else's story as if it were my own, as I hear of that sort of thing happening a lot)

He cheerily waved me over to the display of immigration forms and told me to apply for a "seven-day tourist visa," which was a class of Tourist Visa that I did not know even existed (if in fact he had not simply invented it for my benefit), and that extra seven days gave me enough time to arrange my next move -- My Thai pastor arranged for me to get a Volunteer Visa through a Foundation run by ANOTHER pastor that he knew, and by the time my 7 days were up, I had the proper paperwork in hand to get my Volunteer Visa in Penang

FORTUNATELY, the provincial immigration officer already knew me (I had voluntarily helped several foreign university students with visa issues, and also several hapless foreigners in unusual situations), and he would later tell me to my face that I was a person (foreigner) who "always tries to do the right thing" -- So if it was for this reason or if it was simply what he normally did, he decided to get me out of my fix)

In 2019, I was summarily separated from a Thai employer (a fairly prestigious Thai employer in place that used to be called "Nakhon Si Nowhere") that I was actually HAPPY to be separated from -- Problem was, they immediately notified the Labor Office to cancel my Work Permit, and it transpired that I had just 48 hours to get out of Thailand, and I did not learn about this UNTIL IT WAS ALREADY TOO LATE TO GET OUT OF THE COUNTRY (NST planes still flew only to Bangkok (and, everybody, I am certain
@Brandon ***********
knows EXACTLY where NST is, so PLEASE no comments, as that provincial code is VERY easy to look up)

, I think this is the first time I have ever contradicted you in this group -- I my personal experience a Thai employer CAN do something like this, though SOMETIMES a provincial immigration officer might soften the blow in your favor, if they know you and like you
