What can I do if my Thai partner stole 70,000 baht from me?

Thai partner stole 70000 baht from me, what would the police do in this circumstance?

I gave him the money, to help pay for a business which didn’t plan out. He kept the money, as we were looking for other options and said he’ll keep it there to pay, so we didn’t get bank charges sending it back & forth.

No business plans out, im asking for the money back , many excuses to not repay etc. turns out he’s gambled and smoked all the money away.

He’s begged me not to go to the police, I’ve accepted I will not get the money back and he has no way of paying it back. I feel also like the police would not help as it’s his word against mine, not a direct theft. But I also feel foolish as he’s essentially getting off free? Would he be forced to repay, or prison? Or would they not care?

P.S I also already know I’m a prize idiot for trusting him.

TLDR : Answer Summary
The questioner describes a situation where they lent 70,000 baht to their Thai partner to support a business venture, which ultimately failed. Despite attempts to recover the money, the partner has made excuses and allegedly spent it on gambling. The questioner fears that police involvement would lead to no action, as it may be viewed as a dispute rather than theft. Comments in response suggest that lending money in such contexts is often viewed as a gift rather than a loan, and that legal recourse could be difficult and costly. Common advice includes viewing the experience as a learning opportunity and avoiding similar situations in the future.

I would go to the police and report. The police decides if they start a criminal case or not. Nothing lost. Winning the criminal case does not mean you get your money back, for that you need to start a civil case yourself.
Roger ********
If you have any documentation for all this, you should speak to a Thai attorney.
Budsara **********
Sorry for your experience. I am a lawyer. You didn’t give him as a gift but for your business. If you gave him the money in order to do something for you and he didn’t comply and refused to pay you back several time it may be considering guilty of embezzlement which is a criminal case, this is not a civil case. This case is a compromising offense. Please report this to the police so they can take legal action against him. He may be trying to get money to pay you back because he doesn't want to go to jail. Once you receive your money back, you may withdraw your report to the police.

According to the Criminal Code, Section 352 states that anyone who possesses another person's property or owned by others as well fraudulently misappropriating property that belongs to oneself or a third party That person commits an offense of embezzlement. Must be punished with imprisonment not exceeding 3 years or a fine not exceeding 60,000 baht, or both.

Never happened to me yet, but i also realised that Thai and Indonesians somehow get mad with Money. You can for example never give a Friend Money for something or someone else. It will never reach the Destination. They don't think like Western. Even if this kills the Relationship for ever, they do it. I heard from one Case, where a Man was working 20 years for the Owner of a very nicely done beautiful Hotel in Lombok. Sadly the Owner put the name of this 20 years long good worker into the Ownership of the Hotel, to make things easier for him. Then the Indonesian acted like "Who are you? This is my Land and Hotel."

I love Indonesia and the people here. I really admire them. They are the nicest in the World for me. But with Money, they can not deal with this and behave highly irrational.

All you can do is write it off to experience. It's fortunately a small amount. A lot of comments here about Thais, men, women... Just remember not all Thais are like that. Next time you meet someone just keep your finances separate from the relationship, nothing wrong with sharing or paying more if you have more money, but your finances are yours alone and loans are mostly ~ gifts xx

The police will ask for commission to pursue it... Then there is still no guarantee he will get in trouble or you get your money back. Youd get ripped off again.... It happens all over Thailand. Craig *********
@Kyle *********
well never should stereotype but I ve been here 10+ years and that’s the way it works. It also doesn’t matter if your farang, Thai, Malaysian etc. You must take your western values and traditions, check them at the door and live like a Thai if you want to avoid these issues. It’s their way and you need to respect it. Like boxing protect yourself at all times.
Kyle **********
@Craig ********
Maybe depends what part you live and if the western man is being used for only 1 thing. I mean my girlfriend works in an office 6 days per week earns her own money, he sister works in health department, sisters boyfriend IT tech.. all of them work and don't expect me to pay for everything, If it's a small village say in ISAN maybe completely different, or bar girls in Pattaya. Bangkok has a population of over 11 million 🤷‍♂️

I mean I find thai culture pretty easy to adapt to but being used as an ATM is not thai culture, I see plenty of Women working harder than the men.
Kim *********

hi - I live in a small village in Isaan and I only help my wife with money and sometimes her grown up daughter. I have a great relationship with the family and they expect nothing 😊

Arr fair does that's good, there is genuine of course I think alot of thais are very kind and stereotyped.

I'm pretty much the same like often even if I try to pay for a meal her sister and sisters boyfriend will say no and are quiet proud. My girlfriend only actually earns 15k baht a month so I'm happy to help her out but she passed the tests on 1st dayes paying her share. I tell her not to do overtime but she always ignores anyway 😂 Did give her 15k baht for her birthday though and she was shocked haha which in reality for me is just a few days work. So yes gifts and treats but same as with a western girl I'd never let them leach or expect it.

@Kyle *********
I would say the women in most cases always work harder than the men. I would agree that in larger ergonomic communities such as BKK there is a changing culture and more middle class. How long have you been in Thailand? You did say they (gf and family) don’t expect you to pay for everything. You shouldnt have to pay for anything except as a gift.

I think you will find, and please ask your girlfriend about lending money to Thais. Even she I am sure will tell you to be careful. As per this post it has nothing to do with who pays who its about lending money within the Thai culture. Treat it as a gift expecting no return and you will be ok. Bartering is something also completely different. There is a reason it takes a longer to close most larger deals in Thailand (land, cars, boats etc). I’ve seen it on every front but shouldn’t be considered derogatory but part of the culture. Those of us who live here just except it and play along and have a good laugh. Thailand is still one of the best places around.
Kyle **********
@Craig ********
2 years ago, left my job and went to travel then ended up living between there and Australia. My girlfriend is from Bkk but she baught a condo just outside as its cheaper and her work is there.

At the moment I'm back in the UK working, we're just tryna figure out what to do I think she will be coming here we will both work for a while then return. I'm back over in 6 weeks but just a holiday to see her, then she'll come here on tourist visa first after Christmas then eventually for a few years so we can both rack up abit of money.

I'd been previously a place called Chiang Kham a few hours from Chiang Rai, an old friend lived there for 7 years, was married to a thai teacher who's family owned a school and had to kids together. They're divorced now though and he's been back sometime. He did say a few things though like when he played for a football team after a match all the lads would order beers and expect him to pay, also he had to pay his ex wifes mother like £3000 to marry her 😬 this is like 12 years ago. In general though he was skint and her family looked after him

Thai women are not worst. The men feed off of the women here, so they are worst. But at least with the women, we get something in return. I just tell all my side pieces. If you want something, just ask. Don't do anything stupid. Money I have, but you do not want to lose my trust on petty things.
