What are the rules for applying for a new extension on a Non-Immigrant 'O' visa in Thailand if I enter the country on the last day of my current visa?

If I enter the country on the last day of the Non-Immigrant "O" annual visa, do I have to go to immigration straight away to apply for another year, or can I do it in a similar way to the "90-day report", i.e. before 3 months have passed? TIAπŸ™

TLDR : Answer Summary
If you enter Thailand on the last day of your Non-Immigrant "O" visa, you need to understand your options regarding visa extension. You cannot simply wait until before the 3-month mark to apply for your extension; you must go to immigration to apply for a new one before your current visa expires to avoid overstay fines. It’s recommended to check your passport for specific dates that indicate the last day an extension can be requested. Ideally, you should try to arrive in Thailand before your visa's expiration date or immediately go to immigration to apply for your extension to minimize any overstay penalties.

Well we got it sorted,

Tomasz the visa from the UK was NOT useless as that's what got you stamped in for 90 days AND that's what you're going to apply for the year extension on at the immigration office

WITHOUT that visa you'd start all over from scratch, but with it you just apply for the year extension when you have 30 days or less left on your new 90 day stamp (and meet the proof of funds.)

Take care, good luck with your upcoming yearly extension

Finally, I applied as
@Tod ********
suggested for a visa to avoid the daily fee πŸ˜‰ a Long time I didn't apply at the Thai embassy in the UK . Now don't need to send a passport and the visa comes as a pdf document on provided email, in my case 4 days. Now a bit of a breather after landing, no need to go straight to immigration.

This will be the second extension of the marriage visa

The first was on the basis of a 400,000THB deposit

Now it will be on the basis of a monthly income of 40,000 THB. We will see if it goes smoothly, I will let you know guys ;)BR

Hi,
@Tod ********
I entered the country with a NON-O visa from the UK, BUT the immigration officer said that if I wanted to use such a visa, I would have to start all paperwork from scratch (i.e. annual extension etc), he gave me a stamp for three months πŸ˜› So the visa from the UK was useless, therefore I do not know if this is a normal procedure or if he did me a favour. I am writing to let you know how it all turned out. BR πŸ˜‰

Now that we ascertained
@Tomasz *********
you are indeed on an extension of stay (with a valid re-entry permit) which is good until 19th sept 202

IF you show up ere that day you'll get stamped in for just that day, that's it

AND

you'll go on overstay at 500 baht a day until until you get to the immigration office to apply for your yearly extension.

SO if there's anyway you can get back sooner it'd be in your best interest, otherwise you're gonna get overstay fines until you get the new extension applied for. The good thing is the 19 IS a monday and that means you could go to the immigration office on the 20th and only have one day overstay at 500baht when you apply for your new extension

I think you need to LOOK in your passport at your "non immigrant O annual visa" and see what the stamp actually says.

IF you got it last year from the immigration office and it says "extension of stay permitted until" with a date on it that means that date is the last day you can apply for a new yearly extension SO if you were to show up on that date you'd get stamped in 1 day, you'd go on overstay until you get to the office and apply for another extension.

now on the off chance you have a year-long, multi-entry Non-O visa that you bought from a thai consulate in YOUR country (where you get stamped in for 90 days and then have to leave the country after that) you could enter the last day the visa sticker (or PDF print out) was valid and get stamped in for 90 days.

BUT

If I was a betting man, I'd be dollars to durian you have a year long "extension of stay" not any visa at all .

That stamp actually let you stay in Thailand. A re-entry permit is let you enter using that pre-existing stamp.

So, your question is already answered by

in the very first comment.

Thanks again for the very detailed explanation! πŸ™

I can apply for Non-Immigrant O (Visiting family) in the UK, but does this make sense? and whether it will not interfere with an existing visa?
Tod *********
@Tomasz *********
either get a new 90 day Non-O visa based on marriage to a thai (seeing as that's what you have this extension for (it is written on the top under consideration stamp in thai) and then come in, get the 90 day stamp and after that when you have 30 days or less left on the stamp apply for the year extension.

IF you have time and can meet the requirements to do that (which you do using the ONLINE eVisa website) that would get you out of the overstay fines between when you land and when you can get to the immigration office

****************************

The choice is really Visiting or staying with the applicants Family resided in thailand (more than 60 days) <- that's the Non-O for marriage or raising children)

One thing that doesn't give me peace of mind πŸ€”

How can they count my overstay until I reach the office if my passport is from a country where I don't need a visa for up to 30 days? Perhaps I understand wrong but of my mind even if I not appear at the office, I'm still eligible to be in the country 30 days on the stamp.. or I'm completely wrong?
Tod *********
Yep
@Tomasz *********
you're completely wrong πŸ˜•

you are NOT entering on a visa exempt entry, you're comin' back on a VALID extension and re-entry permit (granted that is only good for one day) You're confusing entry types.

That you get a 30 day visa exempt entry IF you enter without any valid extension/re-entry permit doesn't factor into it at all. You're NOT eligible for a 30 day visa exempt entry because you're HAVE a valid extension/re-entry permit in your passport now

AND

just so you're clear, If you did come in on a 30 day visa exempt you'd then have to apply for the in country 90 day Non-O visa, wait for that to get reviewed, go back get it stamped in, wait two months then go back and apply for the year extension. So comin' in on a 30 day visa exempt wipes the slate completely and you have to start all over from zero.

Personally I'd figure out a way to change the date and get back here with enough time BEFORE your extension expires so you don't run yourself off the rails.

BUT you know what you're options are now (and as I said in the beginning, you DID have an extension of stay πŸ˜› )

Good luck,
Martynus ********

Ok, but what I should do after landing? Do I have to go to immigration straight away to apply for another year?
Ellie *******
Yes, exactly, and it says "Extension of stay".
Ellie *******
@Tomasz *********
, Definitely you have an extension of stay unless you had Non-OA (<- with A) on 2021. Those stamps are "additional" ones on-top of your extension of stay. What you showed here is a "re-entry permit" which you cannot apply for unless you have a stamp valid until 19 Sep 2022. Check your passport through until you find another stamp that has 19th September 2022 as until date, then please upload it here.

, no because 1st photo is the entry stamp on the re-entry permit which is shown in 2nd photo. You have to have one more stamp with the date of 19 Sep 2022.

@Tomasz *********
You should have a stamp that was issued (inked in) on or before 20 October 2021, valid until 19 Sep 2022. Please seek that stamp.
