What are the requirements for re-entering Thailand on a DTV visa and tax obligations after 180 days?

Hi everyone,

regarding the DTV visa, I understand that you have to sign up for programs like Muai Thay, cooking classes or others to get it. This means that I have to complete a relevant program in the first 180 days. What happens if I leave the country after 180 days and re-enter 2 weeks later and get another 180 day stay? Do I have to participate in a program again each time I re-enter the country?

Another question: Do I have to file a tax return and pay taxes if I stay in the country for more than 180 days a year due to re-entry with the DTV?

Leaving and re-entering requires no new registration. You have your multiple entry visa and fulfilled the application requirements. You only need to produce the printout of the approval PDF or show the sticker in your passport.

This means that after I have completed a recognized cooking class in the first 180 days, there are no more requirements for the rest of the 5 year validity period, of the DTV, except the 90 day report? Is that right?

Tax will depend on being inside Thailand for 180 days in a tax year and whether you bring income into Thailand in that year or not

I thought this was a proposal, and not yet the actual law. This has yet to be clarified by Thai authorities

I'm afraid not. It's been the law for a very long time. There was an official announcement last year that changes how the Thai Revenue Department treats income brought into Thailand for tax purposes. It came into effect on the 1st of January this year.

The Tax is yet another to see how well it's enforced and whether it's Global tax or Monies deposited into a Thai Bank Account...

Think it'll still possibly 18 months to 2 years away before it'll be getting worked out properly

If you are Thai Tax Resident it is only monies remitted to Thailand that are assessable. It would need a change of law for it to be taxed on all global income.

all this chat about "new" tax rules, there is nothing "new" about the requirement to complete and file a tax return after spending more than 180 days in the country, that has always been the case for a long time, if someone doesn't own a business, or they are not doing any kind of work in Thailand, such as retirees, the vast majority of these people have not done anything and will probably continue to do nothing, weather it is enforced in the future will remain to be seen, it could be enforced by maybe making it a visa requirement, or thai banks could request extra documents, to sustain or open an account. All these digital nomads giving all their personal information, regarding earnings and tax status, for all you know all that information, could be evidence gathering, for a future clamp down on people working from within Thailand, and not being registered for paying tax, because in past most digital nomads just hid away in a hotel room somewhere, and did nothing, and will probably continue to do so.

I think potential questions n further paperwork will probably be required if wanting to get an extension at immigration within the Kingdom

Still too early to know if they require additional courses etc ...

But most other visa types they don't ask at Passport control when re-entring etc...

Can also apply for the DTV visa as digital nomad/ freelance worker etc
