First, thank you to everybody that contributes on Visa advice. i’ve been in Thailand for eight months. I’ve been doing Visa runs along with the visit back to the USA.

 I’m using a Visa agent, star visa in Chiang Mai

 they helped me get married last week to a Thai lady. now they say I have to go to their office in Laos and get a Type O visa.

 I already have the ฿400,000 in American dollars in my Charles Schwab checking account. That account is only two months old.

 they’re telling me that they need to see that I’ve had at least $1000 in my other checking account for the last three months. They didn’t tell me when I started this process two months ago. My average balance has been over $1000 but there’s been periods where it went less than 1000. Is this something that’s true

TLDR : Answer Summary
The user, who has been in Thailand for eight months and recently got married to a Thai citizen, is seeking clarity on the requirements for obtaining a Type O visa. They currently have ฿400,000 in a US bank account and are being told by their visa agent that they also need a checking account with at least $1,000 for three months, which hasn't been the case. Comments from the community suggest that the 400,000 THB does not necessarily need to be in a Thai bank for the initial visa application and provide alternative options for extending their stay.

(please exchange "he" with "you") . . . While for the application to the 90-days Non-Imm-O Marriage Visa outside of Thailand, the required 400,000 THB can sit in ANY bank account ANYWHERE in the World as long as he can prove the account is in his sole name,

The 2 months seasoning of the 400,000 THB in a Thai bank account is the official requirement for the application to the 1-year Extension of the Stay Permit Based on Marriage to a Thai Wife, but sadly, some Immigrations want to see a 3-months seasoning.

These Immigrations seek to drive the applicants into the fangs of agents and pay tea money, because they know you just can't fulfill this 3-month requirement on a 90-days Non-Imm-O marriage visa.

He has another, very viable option:

He can buy more time by applying to the 60-days "family visit" extension near the expiry date of the 90 days out of the Non-O visa.

However, to be able to apply for the 60-days extension, he needs a freshly printed Kor Ror 22 or 2 (whichever applies) from an Amphoe to show Immigration that his marriage to a Thai is registered inside Thailand

wow thank you so much. they make it so confusing. But yes, I know that my agent pays the government. It was worth it at the Department to get married because we went past a lot of people that were in line.

A good agent could have done everything inside thailand. First time I am hearing agent telling someone to go to Laos

I will challenge them on that. It would be nice if I didn’t have to leave Thailand

I agree. I'm not very impressed with that agent.

You will need to enter Laos and then apply online via the consulate that serves the area of Laos you are in showing all the information you are required to provide, bank details, marriage certificate etc and remain in Laos until the visa is issued

The 400,000 baht has to be in a Thai bank

@Jon *******
it can be in US account but will have to get embassy invovled to verify or state department in US to certify

@Andrew *******
I never heard that one before. Always has to be in a Thai bank account.

the visa is different from the extension. Evisa from Laos just has to show proof of funds in his name. If he were applying in Thailand it would have to be in a Thai bank.

how do you think people apply for a DTV and NOT BEEN in thailand before how do you think its processed by people who can not get bank accounts and now DTV are not qualified for bank accounts due to recent regulations. The issue with using american account is the exchange rates changes.

You may have the equivalent at process but later the exchange changes and yiu dont. You can also convert USD into thai baht at an american bank and place it in savings account. Then providing said bank statements to the state department for certification if needed. Yes its easier to have a thai bank for it but again

How can they have a thai bank when they are NOT in thailand applying for first time.

As well you can not be in thailand to apply for DTV

The money required must be in a Thai bank account 2 months prior to the day you apply for a 12 months extension at the local immigration office. That's the official requirement.

you are right, 2 months are the official requirement, but sadly, some Immigrations want to see a 3-months seasoning. He'll need those 400k in a Thai bank account when he's extending the stay another 12 months at his local immigration office.That's non-negotiable.

yes providing his visa qualifies him for a bank account they are getting strict but again as long as the funds are in a deposit account not investment he will be good thai account or otherwise
