What are my options for staying in Thailand after resigning and what about the visa cancellation process?

Just want to confirm my options. I resigned work and my last days is 31st May. So my employer will cancel my work visa and the labour department will notify immigration to cancel my Non B VISA linked to it.

after reading all about it I'm still not clear if I fall under the amnesty rule? Also do I need to go to immigration?

Before COVID I had approval on the setup of a BOI in Thailand but COVID slowed down establishing it completely. Plan was to get WP/Smart VISA using this. But it will be somewhere in July now before I can do that.

Follow the rules and all is good, ignore the rules and it can bite you in the ass later as you signed you know what to do.

never needed to do anything my company took care of everything. No need to worry. Now I have to do it myself so trying to read up and inform myself. But agree should have kept track of this myself...

Just for information: In my local Labour Office, they will not allow the work permit to be cancelled unless it is done by the employer. They will also not allow it to be cancelled in advance of the termination of employment date. It must be done on the actual termination of employment date, which obviously means you can't cancel your extension of stay based on work at Immigration in advance either, since they require the receipt from the Labour Office.

So, different provinces, different rules, which make things that should be simple, that bit less so. :)

got the same message from HR at my work. Had to provide them work permit and passport and they said by law they needed to start the cancelation process.

Just so you're clear, it's NOT your employers responsibility to cancel your work permit and go cancel your extension it's yours (the extension is in YOUR passport and the work permit is in YOUR name).

And what happens if neither are cancelled and just left to expire?

Are you on the original 90 day VISA entry or are you on an extension of stay from the immigration office? That makes a difference on what you need to do

IF you are on the original 90 day VISA stamp you just cancel your work permit and let the stamp run out and you will go onto the amnesty,

BUT

if you are on an extension of stay you need to cancel your work permit, then take that receipt and your termination paperwork to the immigration office to cancel your extension. They will cancel it and then stamp you in on a new stamp until the last day you work (the 31st) and then after that you will go on the amnesty.
